        Introduced  by M. of A. JENNE -- read once and referred to the Committee
          on Energy
        AN ACT to amend the public service law, in relation to the  location  of
          certain  wind  electric  generation  facilities; and providing for the
          repeal of such provisions upon expiration thereof
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. Section 168 of the public service law is amended by adding
     2  a new subdivision 3-a to read as follows:
     3    3-a. The state shall not grant funding for the construction or  opera-
     4  tion of a wind electric generation facility to be located within:
     5    (a) ten miles of the Wheeler-Sack army airfield;
     6    (b) ten miles of the Montague weather station;
     7    (c) five miles of the boundary of the Wheeler-Sack army airfield regu-
     8  lated  airspace  located within St.  Lawrence, Jefferson and Lewis coun-
     9  ties;
    10    (d) five miles of the boundary of the Wheeler-Sack army airfield class
    11  D controlled airspace;
    12    (e) the Wheeler-Sack army airfield class D controlled airspace; or
    13    (f) the enclosed area beginning at the point where United States route
    14  eleven intersects New York route twenty-six;  then  north  along  United
    15  States  route eleven to New York route fifty-six; thence south along New
    16  York route fifty-six to the border of the Adirondack state park;  thence
    17  west  along  the border of the Adirondack state park to a point directly
    18  due east of the intersection of United States route eleven and New  York
    19  route  twenty-six;  thence  due west until the point where United States
    20  route eleven intersects New York route twenty-six.
    21    § 2. This act shall take effect immediately; provided,  however,  that
    22  this  act  shall  be  deemed  repealed fifteen years after it shall have
    23  become a law.
