AN ACT to amend the elder law, in relation to the state office for the
aging sexual discrimination training program; and to repeal certain
provisions of such law related thereto
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Subdivisions 15 and 16 of section 202 of the elder law,
2 subdivision 15 as amended by section 31-b of part AA of chapter 56 of
3 the laws of 2019, and subdivision 16 as added by chapter 455 of the laws
4 of 2016, are amended and a new subdivision 17 is added to read as
5 follows:
6 15. to periodically, in consultation with the state director of veter-
7 ans' services, review the programs operated by the office to ensure that
8 the needs of the state's aging veteran population are being met and to
9 develop improvements to programs to meet such needs; [and]
10 16. to the extent appropriations are available, and in consultation
11 with the office of children and family services, conduct a public educa-
12 tion campaign that emphasizes zero-tolerance for elder abuse. Such
13 campaign shall include information about the signs and symptoms of elder
14 abuse, identification of potential causes of elder abuse, resources
15 available to assist in the prevention of elder abuse, where suspected
16 elder abuse can be reported, contact information for programs offering
17 services to victims of elder abuse such as counseling, and assistance
18 with arranging personal care and shelter. Such campaign may include, but
19 not be limited to: printed educational and informational materials;
20 audio, video, electronic, other media; and public service announcements
21 or advertisements[.]; and
22 17. subject to an appropriation, make available to designated agencies
23 as defined in paragraph (a) of subdivision one of section two hundred
24 fourteen of this title, a training program for the purpose of raising
25 awareness, removing barriers and improving services for older adults
26 based on their sexual orientation and gender identity or expression as

1 defined in section two hundred ninety-two of the executive law. Such
2 training program may include:
3 (i) an overview of the history, unique needs, and concerns of lesbian,
4 gay, bisexual, transgender, asexual, gender non-conforming and gender
5 non-binary older adults;
6 (ii) reasons why lesbian, gay, bisexual, transgender, asexual, gender
7 non-conforming and gender non-binary older adults may choose not to
8 self-identify; and
9 (iii) tools that may be used to incorporate lesbian, gay, bisexual,
10 transgender, asexual, gender non-conforming and gender non-binary older
11 adult concerns into direct care and steps that may be taken to improve
12 the quality of services and support provided.
13 § 2. Subdivisions 13 and 14 of section 203 of the elder law, as added
14 by a chapter of the laws of 2019, amending the elder law relating to the
15 state office for the aging sexual discrimination training program, as
16 proposed in legislative bills numbers S. 5958 and A. 7593, are REPEALED.
17 § 3. This act shall take effect on the same date and in the same
18 manner as a chapter of the laws of 2019, amending the elder law relating
19 to the state office for the aging sexual discrimination training
20 program, as proposed in legislative bills numbers S. 5958 and A. 7593,
21 takes effect.
