DAVILA, FAHY, JAFFEE, KIM, LAVINE, ROBINSON, SOLAGES, STECK -- read once and referred to the Committee on Children and Families AN ACT to amend the social services law, in relation to creating the child care regulatory review task force THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The social services law is amended by adding a new section 2 390-i to read as follows: 3 S 390-I. THE CHILD CARE REGULATORY REVIEW TASK FORCE. 1. DUTIES. (A) 4 PURSUANT TO THE PROVISIONS OF THIS SECTION, THE CHILD CARE REGULATORY 5 REVIEW TASK FORCE SHALL REVIEW PROCESSES AND REGULATORY, STATUTORY AND 6 PROGRAMMATIC REQUIREMENTS, PLACED ON CHILD CARE PROVIDERS WHICH ARE 7 REGULATED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES, THAT ARE DUPLI- 8 CATIVE OR UNNECESSARY AND CREATE ADMINISTRATIVE BURDENS FOR CHILD CARE 9 PROVIDERS; 10 (B) HOLD, AT MINIMUM, ONE PUBLIC HEARING TO OBTAIN ORAL AND/OR WRITTEN 11 TESTIMONY FROM INTERESTED STAKEHOLDERS; 12 (C) DEVELOP AND PROPOSE RECOMMENDATIONS FOR THE STREAMLINING OF 13 CURRENT PROCESSES AND REQUIREMENTS WHICH ARE IDENTIFIED AS DUPLICATIVE 14 OR BURDENSOME; 15 (D) SUCH RECOMMENDATIONS SHALL BE SUBMITTED TO THE LEGISLATURE ANNUAL- 16 LY. 17 2. MEMBERSHIP. (A) THE TASK FORCE SHALL CONSIST OF, AT A MINIMUM, THE 18 COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES; THE COMMIS- 19 SIONER OF THE OFFICE OF TEMPORARY AND DISABILITY ASSISTANCE; THE COMMIS- 20 SIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES; THE COMMISSIONER 21 OF THE DEPARTMENT OF HEALTH AND THE COMMISSIONER OF THE NEW YORK CITY 22 DEPARTMENT OF HEALTH AND MENTAL HYGIENE. 23 (B) THE MEMBERS OF THE CHILD CARE REGULATORY TASK FORCE SHALL NOT 24 RECEIVE ANY COMPENSATION. HOWEVER, THE MEMBERS SHALL BE ENTITLED TO 25 REIMBURSEMENT FOR ANY NECESSARY EXPENSES INCURRED IN CONNECTION WITH THE 26 PERFORMANCE OF THEIR DUTIES. EVERY STATE DEPARTMENT, AGENCY, DIVISION, BOARD, BUREAU, COMMISSION 2 AND ANY OTHER RELEVANT ENTITY SHALL PROVIDE ALL NECESSARY ASSISTANCE 3 AND/OR INFORMATION TO THE CHILD CARE REGULATORY REVIEW TASK FORCE TO 4 CARRY OUT ITS DUTIES AS AUTHORIZED BY SUBDIVISION ONE OF THIS SECTION, 5 UNLESS OTHERWISE PROTECTED BY LAW. 6 4. ANY INFORMATION OBTAINED BY A MEMBER OF THE CHILD CARE REGULATORY 7 REVIEW TASK FORCE WHILE CARRYING OUT ANY DUTIES AS PRESCRIBED IN SUBDI- 8 VISION ONE OF THIS SECTION SHALL ONLY BE UTILIZED IN HIS OR HER CAPACITY 9 AS A MEMBER OF THE CHILD CARE REGULATORY REVIEW TASK FORCE. 10 S 2. This act shall take effect immediately.
