STATE OF NEW YORK ________________________________________________________________________ 8810 IN ASSEMBLY January 12, 2022 ___________ Introduced by M. of A. LAVINE -- read once and referred to the Committee on Libraries and Education Technology AN ACT to amend section 3 of chapter 233 of the laws of 2000, relating to authorizing the town boards of the towns of Oyster Bay and North Hempstead, county of Nassau, to establish the Gold Coast public library district, in relation to the time limits for posting publica- tion of notice of election and filing candidate petitions The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivisions 1 and 3 of section 3 of chapter 233 of the 2 laws of 2000, relating to authorizing the town boards of the towns of 3 Oyster Bay and North Hempstead, county of Nassau, to establish the Gold 4 Coast public library district, subdivision 3 as amended by chapter 399 5 of the laws of 2003, are amended to read as follows: 6 1. The public library district described in this act shall not come 7 into existence unless and until it is approved, and the initial proposed 8 budget is approved, by a vote of the majority of the qualified voters 9 voting in an election held pursuant to the following provisions. Upon 10 receipt of a petition signed by not less than one hundred voters quali- 11 fied to vote at a general election, the town boards of the towns of 12 Oyster Bay and North Hempstead shall give notice of an election. If a 13 majority of the voters at said election approved the formation of the 14 district, then the district shall come into existence on the terms and 15 conditions set forth hereinafter. At said election the issues shall be: 16 (a) whether the public library district described in this act shall be 17 created or not; (b) whether the budget therefor proposed shall be 18 approved or disapproved; and (c) the election of nine trustees as 19 further provided by this act. The town board shall designate a polling 20 place which is centrally located and accessible. The town boards shall 21 give notice of said election by the publication of a notice in one or 22 more newspapers having a general circulation in the district to be 23 served. The first publication of such notice shall be not less than 24 [thirteen days and not more than twenty] thirty days prior to the date 25 of such election. LBD13975-01-1A. 8810 2 1 notice to be posted conspicuously in five public places within the 2 proposed district at least [thirteen] thirty days prior to the date of 3 such election. Such notice shall specify the time when and the place 4 where such election will be held, the issues to be decided at said 5 election and the hours during which polls will be open for the receipt 6 of ballots thereof. The town boards shall designate a resident qualified 7 voter of such district to act as chairperson of any election of such 8 district and shall designate not less than two nor more than four resi- 9 dents qualified to act as election inspectors and ballot clerks at such 10 elections. Every voter, otherwise qualified to vote at a general 11 election within the area of the proposed district shall be qualified to 12 vote at said election. After the polls have closed at said election, the 13 election inspectors and the ballot clerks shall immediately canvass 14 publicly the ballots cast and the chairperson of the election shall 15 publicly announce the result. Within seventy-two hours thereafter, the 16 chairperson, election inspectors and ballot clerks shall execute and 17 file a certificate of the result of the canvass with the town clerks of 18 the towns of Oyster Bay and North Hempstead. 19 3. Candidates for the office of member of the board of trustees of the 20 library district shall be nominated by petition. A separate petition 21 shall be required to nominate each candidate for a vacancy on the board. 22 Each petition shall be directed to the town clerk of Oyster Bay, shall 23 be signed by at least fifty qualified voters of the district, shall 24 state the residence of each signer, and shall state the name and resi- 25 dence of the candidate. In the event that any such nominee shall with- 26 draw candidacy prior to the election, such person shall not be consid- 27 ered a candidate unless and until a new petition nominating such person 28 in the same manner and within the same time limitation applicable to 29 other candidates is filed with the town clerk of the town of Oyster Bay. 30 Each petition shall be filed with the town clerk of Oyster Bay between 31 the hours of 9:00 a.m. and 5:00 p.m., not later than the [thirteenth] 32 thirtieth day preceding the election at which time the candidates nomi- 33 nated are to be elected. In the event the district is created, petitions 34 nominating candidates for the board of trustees after the initial 35 election shall be filed with the secretary of the Gold Coast public 36 library district or his or her designee. 37 § 2. This act shall take effect immediately.
