        AN ACT to amend the vehicle and traffic law, in relation to the issuance
          of distinctive number plates for active duty members and  veterans  of
          the armed forces
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 404-ee to read as follows:
     3    §  404-ee.  Distinctive plates for active duty members and veterans of
     4  the armed forces. 1. Any active duty member or veteran of any branch  of
     5  the  armed  forces of the United States or the spouse of any such member
     6  or veteran shall, upon request, be issued  a  distinctive  number  plate
     7  bearing  the  seal  of the appropriate branch of the armed forces being:
     8  the United States Army, the United States Air Force, the  United  States
     9  Coast  Guard,  the United States Marine Corps or the United States Navy.
    10  Application for such number plate shall be filed with  the  commissioner
    11  in such form and detail as the commissioner shall prescribe.
    12    2. The distinctive plate authorized in subdivision one of this section
    13  shall  be  issued upon proof, satisfactory to the commissioner, that the
    14  applicant or the spouse of the applicant is an active duty member  or  a
    15  veteran of such branch of the armed forces of the United States.
    16    3. A distinctive plate issued pursuant to this section shall be issued
    17  in  the  same  manner as other number plates upon payment of the regular
    18  registration fee prescribed by section four hundred one of this  article
    19  provided,  however,  that  an  additional one-time service charge of ten
    20  dollars shall be charged for such plate.
    21    § 2. (a) A distinctive plate established pursuant to section 404-ee of
    22  the vehicle and traffic law shall only be designed, produced and  issued

     1  upon  the  delivery to the department of motor vehicles of a surety bond
     2  in the amount of $6,000, which shall be executed  by  a  surety  company
     3  authorized  by the department of financial services to transact business
     4  in  this  state.  Provided,  however,  that if the commissioner of motor
     5  vehicles shall have received prior to plate design, production and issu-
     6  ance at least two hundred orders for such  distinctive  plates  together
     7  with the additional annual service charge applicable to each such order,
     8  which  shall  be  non-refundable, no such surety bond shall be required.
     9  All service charges collected pursuant to section 404-ee of the  vehicle
    10  and traffic law shall be deposited pursuant to the provisions of section
    11  404-oo of the vehicle and traffic law to the credit of the department of
    12  motor vehicles distinctive plate development fund established by section
    13  95-g  of  the  state  finance  law  and  shall  be  used for the design,
    14  production, advertising and distribution of distinctive  license  plates
    15  in accordance with such section 95-g.
    16    (b) If, upon the expiration of two years following the date upon which
    17  distinctive  plates  in  the  series  are  first  available for sale two
    18  hundred or more sets of such plates are sold, a bond delivered  pursuant
    19  to this section shall be discontinued. If fewer than two hundred sets of
    20  such  plates  are  sold  by  such time, the department of motor vehicles
    21  shall be entitled to recover against the bond in an amount proportionate
    22  to such shortfall.
    23    § 3. This act shall take effect immediately.
