       AN  ACT  to  amend  the  environmental  conservation law, in relation to
         increasing the membership of the marine and coastal  district  of  New
         York conservation, education, and research board
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 1 and paragraph (a) of subdivision 2 of section
    2  13-0503 of the environmental conservation law, subdivision 1 as  amended
    3  by chapter 263 of the laws of 2007 and paragraph (a) of subdivision 2 as
    4  amended  by  section 7 of part LL of chapter 59 of the laws of 2009, are
    5  amended to read as follows:
    6    1. There is hereby established in the department the marine and  coas-
    7  tal  district of New York conservation, education, and research board to
    8  be composed of [three] NINE  members,  [one]  THREE  of  whom  shall  be
    9  appointed  by  the governor, [one] TWO of whom shall be appointed by the
   10  temporary president of the senate,  [and  one]  TWO  of  whom  shall  be
   11  appointed by the speaker of the assembly, ONE OF WHOM SHALL BE APPOINTED
   12  BY  THE MINORITY LEADER OR THE SENATE AND ONE OF WHOM SHALL BE APPOINTED
   13  BY THE MINORITY LEADER OF THE ASSEMBLY.  Each appointing official  shall
   14  also  appoint  an  alternate  who  may  serve in the place of the member
   15  appointed by such appointing official. A member or alternate  member  of
   16  the  board shall serve at the pleasure of the official by whom he or she
   17  is appointed. The members of the board shall choose their chairperson.
   18    (a) receive and review, and to  approve  or  deny,  applications  from
   19  eligible  recipients  for grants from the marine and coastal district of
   20  New York conservation, education, and research fund, created pursuant to

    1  section ninety-five-c  of  the  state  finance  law,  for  conservation,
    2  research,  and  education  projects  relating to such marine and coastal
    3  district. Approval of any such proposed project may be granted  only  by
    4  [unanimous]  MAJORITY  vote of all [three] NINE members of the board. In
    5  the event a member of the board is unable to  vote,  the  alternate  for
    6  such member may vote in his or her place;
    7    S 2.  This act shall take effect immediately.
