BARCLAY -- read once and referred to the Commit- tee on Local Governments AN ACT to amend the village law and the public officers law, in relation to authorizing the village of Mannsville to hire a village clerk who is not a resident of such village The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3-300 of the village law is amended by adding a new 2 subdivision 27 to read as follows: 3 27. Notwithstanding any provisions of this chapter or any other gener- 4 al law, local law, ordinance or special act, the village board of trus- 5 tees of the incorporated village of Mannsville, Jefferson county, may, 6 by resolution, provide that the village clerk of the village of Manns- 7 ville, Jefferson county, need not be a resident of said village, but 8 must be a resident of the county in which such village is located or an 9 adjoining county within the state of New York. 10 § 2. Section 3 of the public officers law is amended by adding a new 11 section 66 to read as follows: 12 66. In the village of Mannsville, in the county of Jefferson, the 13 provisions of this section requiring a person to be a resident of the 14 political subdivision or municipal corporation of the state for which he 15 or she shall be chosen or within which his or her official functions are 16 required to be exercised, shall not prevent a person from holding the 17 office of village clerk of the village of Mannsville, provided that such 18 person resides in the county in which such village is located or an 19 adjoining county within the state of New York. Provided, however, the 20 person performing the functions of village clerk in any other village 21 shall be a resident of such village, unless otherwise provided by an act 22 of the state legislature. 23 § 3.
