Bill Title: Requires electric vehicle charging stations to be installed at gasoline stations in an amount equal to or greater than the number of new gas dispensing motor fuel pumps being installed at such gasoline station; prohibits building permits from being issued when the number of electric vehicle charging stations is not equal to or greater than the number of new gas dispensing motor fuel pumps being installed at such gas station.

        AN ACT to amend the general business law, in relation to requiring elec-
          tric vehicle charging stations to be installed at gasoline stations in
          an amount equal to or greater than the number of  new  gas  dispensing
          nozzles being installed at such gasoline station

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1.   The general business law  is  amended  by  adding  a  new
     2  section 396-xx to read as follows:
     3    §  396-xx.  Gasoline  stations;  electric  vehicle  charging  stations
     4  required. 1. Definitions. As used in this section:
     5    (a) "dealer" shall mean any person owning or operating a  premises  or
     6  facility with four or more gas dispensing nozzles for the retail sale of
     7  motor fuels for use in motor vehicles.
     8    (b)  "electric  vehicle  charging  station"  shall mean a station that
     9  delivers electricity from a source outside an electric vehicle into  one
    10  or  more  electric  vehicles.  An  electric vehicle charging station may
    11  include several charge points simultaneously connecting several electric
    12  vehicles to the station and any related equipment needed  to  facilitate
    13  charging plug-in electric vehicles.
    14    2.  Any  dealer  installing  new gas dispensing nozzles for the retail
    15  sale of motor fuels for use in motor  vehicles  shall  install  electric
    16  vehicle charging stations at such gasoline station in an amount equal to
    17  or greater than the number of new gas dispensing nozzles being installed
    18  at such gasoline station.
    19    3. No building permit shall be issued to a dealer if the documentation
    20  submitted  for such building permit does not reflect the installation of
    21  electric vehicle charging stations in an amount equal to or greater than
    22  the number of new gas dispensing nozzles being installed at  such  gaso-
    23  line station.
    24    § 2. This act shall take effect immediately.
