       AN ACT to amend the elder law, in relation to authorizing certain county
         operated  NY  Connects: Choices for Long Term Care programs to partic-
         ipate in a universal assessment demonstration program
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Subdivision 8 of section 203 of the elder law, as added by
    2  section 18 of part B of chapter 58 of the laws of  2007,  is  renumbered
    3  subdivision 9 and a new subdivision 10 is added to read as follows:
    4    10.  THE  DIRECTOR,  IN  CONSULTATION WITH THE COMMISSIONER OF HEALTH,
    5  SHALL ESTABLISH A UNIFORM ASSESSMENT DEMONSTRATION PROGRAM. THE  PURPOSE
    6  OF  THIS  INITIATIVE  IS  TO  DETERMINE THE EFFECTIVENESS OF THE UNIFORM
    7  ASSESSMENT PROGRAM FUNDED PURSUANT TO CHAPTER FIFTY-THREE OF THE LAWS OF
    8  TWO THOUSAND ELEVEN. THE DIRECTOR SHALL SELECT ONE OR MORE COUNTY  OPER-
    9  ATED  NY  CONNECTS:  CHOICES FOR LONG TERM CARE PROVIDERS TO PARTICIPATE
   10  BASED ON CRITERIA ESTABLISHED BY THE DIRECTOR. THE DEMONSTRATION PROGRAM
   11  SHALL ASSESS WHETHER THE UNIFORM ASSESSMENT TOOL IS EFFECTIVE IN  DETER-
   12  MINING  THE  APPROPRIATE LEVEL OF LONG TERM CARE FOR INDIVIDUALS IN NEED
   13  OF NON-MEDICAL HOME AND COMMUNITY BASED  SERVICES  ADMINISTERED  BY  THE
   14  OFFICE,  OR  ANY  OTHER  PROGRAMS AS DETERMINED BY THE DIRECTOR. FUNDING
   15  SHALL BE MADE AVAILABLE FROM THE APPROPRIATION  MADE  FOR  SERVICES  AND
   16  EXPENSES,  INCLUDING GRANTS, OF THE UNIFORM ASSESSMENT PROGRAM, FROM THE
   17  GENERAL FUND-LOCAL ASSISTANCE ACCOUNT TO THE OFFICE OF  LONG  TERM  CARE
   18  WITHIN  THE  DEPARTMENT OF HEALTH PURSUANT TO CHAPTER FIFTY-THREE OF THE
   19  LAWS OF TWO THOUSAND ELEVEN, AND SHALL BE SUB-ALLOCATED BY  THE  DEPART-
   20  MENT OF HEALTH TO THE OFFICE TO SUPPORT THE ADMINISTRATION OF THE DEMON-
   21  STRATION PROGRAM.
   22    S  2.  This  act shall take effect on the ninetieth day after it shall
   23  have become a law. Effective immediately, the addition, amendment and/or
   24  repeal of any rule or regulation necessary  for  the  implementation  of
   25  this  act  on  its effective date are authorized and directed to be made
   26  and completed on or before such effective date.
