        AN  ACT  to amend the public service law and the public authorities law,
          in relation to requiring combination gas  and  electric  corporations,
          the  New  York  Power Authority and the Long Island Power Authority to
          provide an annual transparency statement to customers
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. Section 44 of the public service law is amended by adding a
     2  new subdivision 6 to read as follows:
     3    6.  Commencing on January first, two thousand twenty-one, every combi-
     4  nation gas and electric corporation on an annual  basis,  shall  provide
     5  each  customer  with an annual transparency statement which shall detail
     6  the following charges on a  gross  basis  which  are  included  in  each
     7  customer's delivery service portion of their utility bill, including but
     8  not  limited  to:  (i)  property  taxes; (ii) sales and compensating use
     9  taxes; (iii) costs and expenses of the commission and department  pursu-
    10  ant  to  section  eighteen-a of this chapter; (iv) gross receipts taxes;
    11  (v) franchise and income taxes; (vi) metropolitan transportation author-
    12  ity payroll taxes; and (vii) fees, charges  and  costs  imposed  by  the
    13  public  service commission which are embedded in the customer bill. Such
    14  fees, charges and costs shall include costs from the  implementation  of
    15  reforming energy vision, energy efficiency, distributed energy resources
    16  and  zero  emission credits. Such transparency statement shall provide a
    17  percentage of the foregoing charges as applied to the average bill of  a
    18  customer of such utility.

     1    § 2. Section 1005 of the public authorities law is amended by adding a
     2  new subdivision 26 to read as follows:
     3    26. Commencing on January first, two thousand twenty-one, the authori-
     4  ty, on an annual basis, shall provide each customer with an annual tran-
     5  sparency  statement  which shall detail the following charges on a gross
     6  basis which are included in each customer's delivery service portion  of
     7  their  utility  bill,  including but not limited to: (i) property taxes;
     8  (ii) sales and compensating use taxes; (iii) costs and expenses  of  the
     9  authority  and  the  public service commission pursuant to section eigh-
    10  teen-a of the public service law; (iv) gross receipts taxes;  (v)  fran-
    11  chise  and  income  taxes;  (vi)  metropolitan  transportation authority
    12  payroll taxes; and (vii) fees, charges and costs imposed by the authori-
    13  ty which are embedded in the customer bill. Such fees, charges and costs
    14  shall include costs from the implementation of reforming energy  vision,
    15  energy  efficiency, distributed energy resources and zero emission cred-
    16  its. Such transparency statement shall provide a percentage of the fore-
    17  going charges as applied to the average bill of a customer of such util-
    18  ity.
    19    § 3. Sections 1020-jj, 1020-kk, and 1020-ll of the public  authorities
    20  law,  as  renumbered  by chapter 415 of the laws of 2017, are renumbered
    21  sections 1020-xx, 1020-yy, and 1020-zz and  a  new  section  1020-jj  is
    22  added to read as follows:
    23    §  1020-jj.  Customer bills. Commencing on January first, two thousand
    24  twenty-one, the authority,  on  an  annual  basis,  shall  provide  each
    25  customer  with  an  annual transparency statement which shall detail the
    26  following charges on a gross basis which are included in each customer's
    27  delivery service portion of their utility bill, including but not limit-
    28  ed to: (i) property taxes; (ii) sales and compensating use taxes;  (iii)
    29  costs  and  expenses  of the authority and the public service commission
    30  pursuant to section eighteen-a of the public  service  law;  (iv)  gross
    31  receipts taxes; (v) franchise and income taxes; (vi) metropolitan trans-
    32  portation  authority  payroll  taxes;  and (vii) fees, charges and costs
    33  imposed by the authority which are embedded in the customer  bill.  Such
    34  fees,  charges  and costs shall include costs from the implementation of
    35  reforming energy vision, energy efficiency, distributed energy resources
    36  and zero emission credits. Such transparency statement shall  provide  a
    37  percentage  of the foregoing charges as applied to the average bill of a
    38  customer of such utility.
    39    § 4. This act shall take effect immediately.
