STATE OF NEW YORK ________________________________________________________________________ 8205 2021-2022 Regular Sessions IN ASSEMBLY August 25, 2021 ___________ Introduced by M. of A. PERRY -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to requiring the submission of building inspection reports The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The executive law is amended by adding a new section 381-a 2 to read as follows: 3 § 381-a. Building inspection reports. 1. When a building inspection 4 report is prepared after a building is inspected, the owner of such 5 building shall submit such report within thirty days of such report 6 being prepared to the appropriate department or official that enforces 7 any building codes, rules and regulations for the local government in 8 the municipality in which the building is located. 9 2. (a) The local government department or official that receives a 10 building inspection report shall review such report and establish a 11 timeframe in which any repairs or improvements to the building identi- 12 fied in such report shall be completed by the owner of such building. 13 (b) Immediately upon the expiration of the timeframe established by 14 the local government department or official, the owner of such building 15 shall submit a certification that the repairs or improvements to the 16 building have been completed to such local government department or 17 official. 18 3. Upon submission of the certification, the local government depart- 19 ment or official may conduct an inspection of the building to ensure 20 that the repairs or improvements were completed. 21 4. Failure to submit the certification or if it is determined that the 22 repairs or improvements to the building identified in the building 23 inspection report have not been completed, the owner of such building 24 shall be subject to penalties. This act shall take effect on the one hundred twentieth day after 2 it shall have become a law. Effective immediately, the addition, amend- 3 ment and/or repeal of any rule or regulation necessary for the implemen- 4 tation of this act on its effective date are authorized to be made on or 5 before such date.
