          tee on Health

        AN ACT to amend the public health law, in relation to applying a special
          Medicaid rate for certain residential health care facilities

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 2-c of section 2808 of the public health law is
     2  amended by adding a new paragraph (h) to read as follows:
     3    (h)  Notwithstanding  any  other provision of law or regulation to the
     4  contrary, any residential health care facility established  pursuant  to
     5  this  article  located in a county larger than two thousand square miles
     6  and operated by an organization with two hundred fifty certified beds or
     7  more in such county on January first, two thousand twenty-one  shall  be
     8  reimbursed  at  a rate of no less than one hundred twenty percent of the
     9  fee-for-service rate  of  reimbursement,  calculated  pursuant  to  this
    10  section,  for  such facility for inpatient services provided on or after
    11  April first, two thousand twenty-one.
    12    § 2. This act shall take effect on the thirtieth day  after  it  shall
    13  have become a law.
