        AN  ACT  to  amend  the  environmental  conservation law, in relation to
          requiring warning labels on all containers that contain bisphenol A

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Section 37-0501 of the environmental conservation law, as
     2  added by chapter 280 of the laws of 2010, is amended to read as follows:
     3  § 37-0501. Short title.
     4    This title shall be known and may be cited as  the  "bisphenol  A-free
     5  [children and babies] act".
     6    §  2.  Section 37-0507 of the environmental conservation law, as added
     7  by chapter 280 of the laws of 2010, is amended to read as follows:
     8  § 37-0507. Product labeling.
     9    1. The commissioner may authorize product labeling of products that do
    10  not contain bisphenol A. The label  on  such  products  may  prominently
    11  state  "Bisphenol  A  Free"  or  "BPA-Free" to inform consumers that the
    12  product does not contain the chemical bisphenol A.
    13    2. A warning label shall be affixed to all containers that contain the
    14  chemical bisphenol A. Such warning label shall clearly state that it  is
    15  harmful  to  an  individual's  health if such container is microwaved or
    16  otherwise heated.
    17    § 3. This act shall take effect on the sixtieth  day  after  it  shall
    18  have  become  a  law.  Effective  immediately,  the addition, amendment,
    19  and/or repeal of any rule or regulation necessary for the implementation
    20  of this act on  its  effective  date  are  authorized  to  be  made  and
    21  completed on or before such effective date.
