          and referred to the Committee on Energy

        AN ACT to amend the energy law, in relation to  prohibiting  the  elimi-
          nation  of  building  systems  or equipment used for the combustion of
          fossil fuels in new building construction

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Section 11-104 of the energy law is amended by adding a new
     2  subdivision 7 to read as follows:
     3    7.  Notwithstanding the provisions of paragraph (b) of subdivision one
     4  of section 11-103 of this article, the code shall not prohibit  building
     5  systems  or equipment used for the combustion of fossil fuels including,
     6  but not limited to, natural gas, propane,  and  fuel  oil,  in  any  new
     7  building construction statewide, nor shall such systems be prohibited in
     8  any  existing building construction statewide, including renovations and
     9  replacement of existing systems.
    10    § 2. This act shall take effect immediately.
