STATE OF NEW YORK ________________________________________________________________________ 6639 2019-2020 Regular Sessions IN ASSEMBLY March 14, 2019 ___________ Introduced by M. of A. WALCZYK -- read once and referred to the Commit- tee on Governmental Operations AN ACT authorizing the commissioner of general services to convey real property at the St. Lawrence psychiatric center to the city of Ogdens- burg The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The commissioner of the office of general services is 2 authorized and empowered to transfer and convey to the city of Ogdens- 3 burg or a private buyer the state property described in section two of 4 this act, said property being a portion of the St. Lawrence Psychiatric 5 Center located in the city of Ogdensburg, St. Lawrence county. Such 6 transfer and conveyance shall be for fair market value and upon such 7 other terms and conditions as said commissioner may determine. Due to 8 the proximity of the land and improvements to be transferred and 9 conveyed to existing mental health and correctional facilities, said 10 terms and conditions of any transfer and conveyance, including the 11 proposed use of said land, shall be subject to the approval of the 12 commissioner of the office of mental health, the commissioner of the 13 department of corrections and community supervision, and the director of 14 the division of budget. 15 § 2. The land authorized by this act to be conveyed consists of one 16 parcel of land at the St. Lawrence Psychiatric Center, in the city of 17 Ogdensburg, St. Lawrence county, and is generally described as follows: 18 Parcel D: 25 acres for Co-Gen development, bounded to the south by 19 Entrance Ave., on the east by Cottage Drive, on the north by Office of 20 Mental Health long-term property, on the west by buildings 32, 34, 35, 21 37 and 42 which are not to be included, to include the Co-generation 22 Plant and building numbers 47, 54, 55, and 103. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04391-01-9A. 6639 2 1 § 3. In addition to the aforementioned, the state may assist the city 2 in marketing and promoting any of the parcel described in section two of 3 this act to private developers. 4 § 4. The description in section two of this act of the land to be 5 conveyed is not intended to be a legal description, but it is intended 6 only to identify the premises to be conveyed. As a condition of 7 purchase, the city of Ogdensburg or private buyer shall submit to the 8 commissioner of the office of general services for said commissioner's 9 approval an accurate survey and description of the lands generally 10 described in section two of this act, which may be used in the convey- 11 ance thereof. Such survey shall be paid for by the land purchaser. 12 § 5. The commissioner of the office of general services shall not 13 grant the land described in section two of this act unless application 14 is made therefor by the city of Ogdensburg or a private buyer within one 15 year after the effective date of this act. 16 § 6. This act shall take effect immediately.
