        AN ACT authorizing the commissioner of general services to  convey  real
          property at the St. Lawrence psychiatric center to the city of Ogdens-
          burg
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The commissioner of  the  office  of  general  services  is
     2  authorized  and  empowered to transfer and convey to the city of Ogdens-
     3  burg the state property described in section two of this act, said prop-
     4  erty being a portion of the St. Lawrence Psychiatric Center  located  in
     5  the  city  of Ogdensburg, St. Lawrence county. Such transfer and convey-
     6  ance shall be for fair market value and upon such other terms and condi-
     7  tions as said commissioner may determine. Due to the  proximity  of  the
     8  land  and improvements to be transferred and conveyed to existing mental
     9  health and correctional facilities, said terms  and  conditions  of  any
    10  transfer  and  conveyance,  including  the proposed use of said land and
    11  improvements and the retention, or  replacement  in  kind,  of  existing
    12  staff housing serving the St. Lawrence Psychiatric Center and located on
    13  the  lands  to  be  conveyed,  shall  be  subject to the approval of the
    14  commissioner of the office of mental health,  the  commissioner  of  the
    15  department of corrections and community supervision, and the director of
    16  the division of budget.

     1    §  2.  The  land authorized by this act to be conveyed consists of two
     2  parcels of land at the St. Lawrence Psychiatric Center, in the  city  of
     3  Ogdensburg, St. Lawrence county, and is generally described as follows:
     4    Parcel  B:  50  acres for residential development bounded by the Saint
     5  Lawrence River to the northwest, on the south by River Drive,  northeast
     6  of  Bridgeview,  to  include  all of the surplus land abutting the Saint
     7  Lawrence River between Bridgeview and Trinity buildings NOT  to  include
     8  building numbers 65, 66, 67, 225 or 226, but to include building numbers
     9  10, 13, 17, 31, 62, 63, 64, 88 and 89.
    10    Parcel  A-3:  6.4 acres for commercial development adjacent to Parcels
    11  A-1 and A-2 and south of property under the jurisdiction of the  depart-
    12  ment  of  corrections  and  community  supervision,  to include building
    13  numbers 48, 68 and 76.
    14    § 3. Any subsequent solicitation for residential  development  by  the
    15  city  of  Ogdensburg  on  Parcel B shall include a requirement that said
    16  development will provide at least fifteen  percent  of  proposed  rental
    17  dwelling  units  to  office  of  mental  health  recipients  in  need of
    18  supported housing, with service  provision  to  be  coordinated  by  the
    19  office  of  mental  health  and a voluntary provider and with said units
    20  subject to OMH Supported Housing Guidelines.   Certain matters  relating
    21  to  this  conveyance  shall  be  determined  pursuant to a memorandum of
    22  understanding between the city of Ogdensburg and the commissioner of the
    23  office of mental  health,  including  but  not  limited  to,  the  exact
    24  percentage  of  set aside units, the dispersal of these units throughout
    25  the proposed residential development so  as  to  avoid  any  clustering,
    26  payment  of  survey costs, and utility connection and road access to the
    27  parcels described in section two of this act. In addition to the  afore-
    28  mentioned,  the state may assist the city in marketing and promoting any
    29  of the parcels described in section two of this act to private  develop-
    30  ers.
    31    §  4.  The  description  in section two of this act of the lands to be
    32  conveyed is not intended to be a legal description, but it  is  intended
    33  only  to  identify  the  premises  to  be  conveyed.  As  a condition of
    34  purchase, the city of Ogdensburg shall submit to the commissioner of the
    35  office of general services for said commissioner's approval an  accurate
    36  survey  and  description of the lands generally described in section two
    37  of this act, which may be used in the conveyance thereof.
    38    § 5. The commissioner of the office  of  general  services  shall  not
    39  grant  the  land described in section two of this act unless application
    40  is made therefor by the city of Ogdensburg within  one  year  after  the
    41  effective date of this act.
    42    § 6. This act shall take effect immediately.
