MAGNARELLI -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to permitting signs, placards or other displays to provide notice that school bus photo violation monitoring systems are in use; and providing for the repeal of such provisions upon the expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 21-h of section 375 of the vehicle and traffic 2 law, as added by chapter 415 of the laws of 1999, is amended to read as 3 follows: 4 21-h. It shall be unlawful for any motor vehicle having a seating 5 capacity of more than seven passengers, and used primarily to transport 6 pupils or pupils and teachers to and from school to be mounted with, or 7 have placed or installed thereon any sign, placard or other display 8 except as provided by law. Provided, however, that the provisions of 9 this subdivision shall not apply to such motor vehicles operating in a 10 city with a population of one million or more. Provided, further, that 11 the provisions of this subdivision shall not apply to a sign, placard, 12 or other display placed or installed for purposes of giving notice that 13 school bus photo violation monitoring systems are used to enforce 14 restrictions on vehicles violating section eleven hundred seventy-four 15 of this chapter by a county, city, town or village that has adopted an 16 owner liability program as authorized by section eleven hundred seventy 17 four-a of this chapter. 18 § 2. Severability. If any clause, sentence, subdivision, paragraph, 19 section or part of this act be adjudged by any court of competent juris- 20 diction to be invalid, or if any federal agency determines in writing 21 that this act would render New York state ineligible for the receipt of 22 federal funds, such judgment or written determination shall not affect, 23 impair or invalidate the remainder thereof, but shall be confined in its EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD09788-01-1A. 6155 2 1 operation to the clause, sentence, subdivision, paragraph, section or 2 part thereof directly involved in the controversy in which such judgment 3 or written determination shall have been rendered. 4 § 3. This act shall take effect on the thirtieth day after it shall 5 have become a law; provided, that this act shall expire and be deemed 6 repealed if any federal agency determines in writing that this act would 7 render New York state ineligible for the receipt of federal funds or any 8 court of competent jurisdiction finally determines that this act would 9 render New York state out of compliance with federal law or regulation; 10 provided further, that the commissioner of transportation or commission- 11 er of motor vehicles shall notify the legislative bill drafting commis- 12 sion upon the occurrence of the provisions of this act in order that the 13 commission may maintain an accurate and timely effective data base of 14 the official text of the laws of the state of New York in furtherance of 15 effectuating the provisions of section 44 of the legislative law and 16 section 70-b of the public officers law. Effective immediately, the 17 addition, amendment and/or repeal of any rule or regulation necessary 18 for the implementation of this act on its effective date are authorized 19 to be made and completed on or before such effective date.
