STIRPE, LUPARDO -- read once and referred to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to includ- ing certain lands used in single operation for the production of tree nuts in the definition of agricultural land The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph b of subdivision 2 of section 301 of the agri- 2 culture and markets law, as amended by chapter 797 of the laws of 1992, 3 is amended to read as follows: 4 b. Fruits, including apples, peaches, grapes, cherries [and], berries, 5 and tree nuts. 6 § 2. Subdivision 4 of section 301 of the agriculture and markets law 7 is amended by adding a new subdivision o to read as follows: 8 o. Land of not less than seven acres used as a single operation for 9 the production for sale of tree nuts when such land is used solely for 10 the purpose of planting a new tree nut orchard and when such land is 11 also owned or rented by a newly established farm operation in its first, 12 second, third, fourth, fifth or sixth year of agricultural production. 13 § 3.
