        AN  ACT to amend the real property tax law, in relation to the equaliza-
          tion in school districts located in more than one city or town
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. Paragraph (d) of subdivision 1 of section 1314 of the real
     2  property tax law, as amended by chapter 158 of  the  laws  of  2002,  is
     3  amended to read as follows:
     4    (d)  Such district superintendent shall also determine what proportion
     5  of any tax to be levied in such  school  district  for  school  purposes
     6  during  the current school year shall be levied upon each part of a city
     7  or town included in such school district by dividing the sum of the full
     8  valuation of real property in such part of a city or town by  the  total
     9  of  all  such  full valuations of real property in such school district.
    10  Such proportions shall be expressed in the nearest exact ten thousandths
    11  and the school authorities of such school district  shall  levy  such  a
    12  proportion  of  any  tax  to be raised in the school district during the
    13  current school year upon each part of a city or town  included  in  such
    14  school  district  as  shall  have been determined by the district super-
    15  intendent. A new proportion shall be determined  for  each  school  year
    16  thereafter  by  the  district  superintendent  in  accordance  with  the
    17  provisions of this section by the use  of  the  [latest]  current  state
    18  equalization  rates then in effect.  In any such school district that is
    19  not within the jurisdiction of a district superintendent of schools, the
    20  duties which would otherwise be performed by the district superintendent
    21  under the provisions of this section, shall be performed by  the  school
    22  authorities of such district.
    23    §  2. This act shall take effect on the first of January next succeed-
    24  ing the date on which it shall have become a law.
