       AN  ACT to amend the tax law, in relation to authorizing the creation of
         the veteran assistance lottery game
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The tax law is amended by adding a new section 1621 to read
    2  as follows:
    3    S 1621. VETERAN ASSISTANCE LOTTERY GAME. 1. THE DIRECTOR SHALL DEVELOP
    4  AND  IMPLEMENT NO MORE THAN TWO SCRATCH-OFF LOTTERY GAMES WHOSE REVENUE,
    5  AFTER PAYMENT OF PRIZES AND  ASSOCIATED  ADMINISTRATIVE  COSTS  OF  SUCH
    6  GAMES,  SHALL  BE  DEPOSITED IN THE VETERANS' TUITION AWARDS ACCOUNT AND
    7  SHALL BE KEPT SEPARATE AND NOT COMMINGLED WITH OTHER FUNDS  OR  ACCOUNTS
    8  OF  THE  STATE.   THIS LOTTERY GAME SHALL BE MARKETED AND DISTRIBUTED IN
    9  THE SAME MANNER AS ALL LOTTERY GAMES CONTROLLED BY  THE  DIVISION.  THIS
   10  SECTION  SHALL  NOT  DIMINISH  ANY  EFFORTS OR FUNDING FOR OTHER LOTTERY
   11  GAMES UNDER THE CONTROL OF THE DIVISION. EACH TICKET SHALL CLEARLY STATE
   12  THAT ALL PROCEEDS FROM TICKET SALES GO  TOWARDS  THE  VETERANS'  TUITION
   13  AWARDS  PROGRAM  ESTABLISHED  BY SECTION SIX HUNDRED SIXTY-NINE-A OF THE
   14  EDUCATION LAW.
   15    2. THE DIVISION SHALL ESTABLISH AND BEGIN SELLING TICKETS AS  REQUIRED
   16  BY  THIS SECTION NO LATER THAN DECEMBER THIRTY-FIRST, TWO THOUSAND THIR-
   17  TEEN.
   18    S 2. Section 1601 of the tax law, as amended by  chapter  913  of  the
   19  laws of 1977, is amended to read as follows:
   20    S 1601. Statement of purpose. This article is enacted to implement the
   21  amendment  of  section nine of article one of the state constitution, as
   22  approved by the vote of the people in the general election of  November,
   23  nineteen  hundred  sixty-six,  and  to  carry out the mandate thereof by
   24  establishing a lottery to be operated by the state, the net proceeds  of
   25  which,  for  the  fiscal  year  commencing April first, nineteen hundred

    1  seventy-six only, are to be  applied  exclusively  for  the  purpose  of
    2  providing  aid  to pupils with special educational needs and pupils with
    3  handicapping conditions. Thereafter, such net proceeds shall be  applied
    4  for  the  purpose  of  providing supplemental aid to all school children
    5  pursuant to subdivision  four  of  section  ninety-two-c  of  the  state
    6  finance  law  so  as  to hold harmless those programs from any reduction
    7  during the next fiscal year and so as to ensure that thereafter, subject
    8  to the provisions of paragraph (v) of subdivision three and  subdivision
    9  five  of  section ninety-two-c of the state finance law and section four
   10  hundred ninety-five-a  of  article  ten-C  of  the  education  law,  all
   11  increases  from  the  proceeds  of  the  lottery  shall  be dedicated as
   12  increases in the funds available for the purpose of this act.   PROVIDED
   13  THAT  NET  PROCEEDS  FROM  THE  VETERAN ASSISTANCE LOTTERY GAME SHALL BE
   14  APPLIED FOR THE PURPOSE OF PROVIDING SUPPLEMENTAL AID TO  THE  VETERANS'
   15  TUITION AWARDS PROGRAM PURSUANT TO SECTION SIXTEEN HUNDRED TWENTY-ONE OF
   16  THIS ARTICLE AND SECTION SIX HUNDRED SIXTY-NINE-A OF THE EDUCATION LAW.
   17    S  3.   This act shall take effect on the ninetieth day after it shall
   18  have become a law.
