        AN ACT to amend the environmental conservation law, in relation to emis-
          sions performance standards from outdoor wood boilers

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Article 19 of the environmental conservation law is amended
     2  by adding a new title 13 to read as follows:

     4                            OUTDOOR WOOD BOILERS

     5  Section 19-1301. Emissions performance standards for outdoor wood  boil-
     6                     ers.
     7  § 19-1301. Emissions performance standards for outdoor wood boilers.
     8    1.  On  or  after June first, two thousand twenty-six, no outdoor wood
     9  boiler shall be used in the state unless such device has been tested  to
    10  determine  its emission performance and heating efficiency and certified
    11  and labeled in accordance with the criteria and procedures specified  in
    12  Subpart AAA of 40 CFR 60 and meets the following particulate air contam-
    13  inant  emission  standard  and the test methodology of the United States
    14  Environmental Protection Agency:
    15    (a) Two and one-half grams per hour for catalytic outdoor  wood  boil-
    16  ers; and
    17    (b)  Four and one-half grams per hour for all other outdoor wood boil-
    18  ers.
    19    2. For the purpose of this section "outdoor wood boilers" means a fuel
    20  burning device that (a) is designed to burn wood or other fuels; (b)  is
    21  specified  by  the manufacturer for outdoor installation or installation
    22  in structures not normally occupied by humans; and (c) is used  to  heat
    23  building  space  and/or  water  via  the distribution, typically through

     1  pipes, of a gas or liquid (e.g. water or water/antifreeze mixture) heat-
     2  ed in the device.
     3    §  2.  This  act shall take effect immediately.  Effective immediately
     4  the addition, amendment and/or repeal of any rule or  regulation  neces-
     5  sary  for  the  implementation  of  this  act  on its effective date are
     6  authorized to be made and completed on or before such date.
