       AN ACT designating state owned lands, located in the hamlet of Westhamp-
         ton, town of Southampton, county of Suffolk, under the jurisdiction of
         the state department of environmental conservation, as  the  Edwin  M.
         Schwenk Memorial Nature Preserve
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Legislative findings. The  legislature  hereby  finds  that
    2  Edwin M. Schwenk has given many years of dedicated public service to the
    3  people  of  Long  Island including major initiatives to protect environ-
    4  mentally sensitive land and open spaces.
    5    In 1993, Edwin Schwenk was directly involved with the creation of  the
    6  Long  Island  Pine  Barrens Protection Act. This legislation created the
    7  third largest land preserve in the state of New York and ended years  of
    8  expensive  litigation  for  the  building  industry while protecting, in
    9  perpetuity, a sole source aquifer.
   10    Edwin Schwenk also helped to spearhead the passage of the Peconic  Bay
   11  Regional  Community  Preservation  Act  which  established a two percent
   12  transfer tax on real estate sales to preserve open space and  recreation
   13  land on the East End of Long Island.
   14    Edwin  Schwenk  passed  away on Thursday, December 17, 2009. The dedi-
   15  cation of this parcel of  land  located  within  the  Long  Island  Pine
   16  Barrens  in  his  name  will memorialize his incredible advocacy for his

    1  community and his unyielding  commitment  to  protecting  Long  Island's
    2  precious environmental resources.
    3    S 2. Notwithstanding any provision of law to the contrary, the approx-
    4  imately  154.3  acres of state land, under the jurisdiction of the state
    5  department of environmental conservation, located at Westhampton, county
    6  of Suffolk, formerly known as the W.J.F. Realty property,  also  identi-
    7  fied  as  Suffolk  County  Tax Map parcels: 0900-217-1-4; 0900-216-1-25;
    8  0900-217-2-16, 0900-217-1-1, shall be known  as  the  Edwin  M.  Schwenk
    9  Memorial  Nature  Preserve.  Said preserve shall be suitably marked in a
   10  manner to be prescribed by the commissioner of the department  of  envi-
   11  ronmental conservation.
   12    S 3. This act shall take effect immediately.
