       AN ACT to enact the "behavioral health and long-term care act" providing
         for the establishment of a behavioral health and long-term care plan
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Short title. This act shall be known and may  be  cited  as
    2  the "behavioral health and long-term care act".
    3    S  2.    The behavioral health and long-term care plan. 1. The commis-
    4  sioner of mental health, in conjunction with the commissioner of health,
    5  the commissioner of alcoholism and  substance  abuse  services  and  the
    6  director  of  the  office  for  the aging, shall develop and monitor the
    7  implementation of a behavioral health and long-term care plan. A subcom-
    8  mittee may be  established  through  the  interagency  geriatric  mental
    9  health  and chemical dependency planning council to assist in the devel-
   10  opment of such plan.
   11    (a) The behavioral health and long-term care plan shall  include,  but
   12  not be limited to:
   13    (i)  Coordination  of  provider  services and interagency referrals of
   14  persons with a mental illness and/or chemical dependence, as defined  in
   15  section  1.03  of  the mental hygiene law, other than and in addition to
   16  dementia, who are in or who may be in need of long-term care,
   17    (ii) Recommendations for integrating and coordinating  federal,  state
   18  and local funding sources for behavioral health and long-term care,
   19    (iii)  Recommendations for facilitating research on best practices and
   20  model programs, and the dissemination of such information,
   21    (iv) An increase in alternatives to  nursing  homes  for  adults  with
   22  mental  illness and/or chemical dependence who also need long-term care,
   23  and

    1    (v) Support services for family  caregivers  who  assist  adults  with
    2  mental  illness  and/or chemical dependence who also need long-term care
    3  in the community rather than in institutions such as adult homes,  nurs-
    4  ing homes or psychiatric inpatient units.
    5    (b)  The  behavioral  health and long-term care plan shall provide for
    6  specific actions to be taken  for  its  implementation,  the  number  of
    7  people  to  be  served,  measurable phases for the implementation, and a
    8  time schedule for the achievement of such phases.
    9    (c) The provisions of the behavioral health and  long-term  care  plan
   10  shall  be  included  in the statewide comprehensive plan of services for
   11  the mentally disabled pursuant to section 5.07  of  the  mental  hygiene
   12  law.
   13    2.  On  or  before  October 1, 2013, the commissioner of mental health
   14  shall submit a report to the governor, the temporary  president  of  the
   15  senate,  and  the speaker of the assembly. On or before October 1, 2014,
   16  and annually until 2021, the commissioner of mental health shall  submit
   17  a report to the governor, the temporary president of the senate, and the
   18  speaker of the assembly regarding the implementation of the plan includ-
   19  ing the number of people served and other measurable outcomes.
   20    S  3.  This  act  shall take effect on the sixtieth day after it shall
   21  have become a law.
