        AN  ACT  to  amend  the executive law, in relation to increasing the per
          student rate of empire state after school program and advantage  after
          school program grants

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The executive law is amended by adding a new section  501-i
     2  to read as follows:
     3    §  501-i. Empire state after school program and advantage after school
     4  program grants. Empire state after school program grants  and  advantage
     5  after  school program grants awarded on or after August first, two thou-
     6  sand twenty-three shall be provided at a rate of no less than four thou-
     7  sand three hundred dollars per approved student. The commissioner of the
     8  office of children and family services, in conjunction with the director
     9  of the budget, shall, upon the completion of the full term of the empire
    10  state after school program and the advantage after school program, modi-
    11  fy the amount of money per approved  student  to  be  awarded  to  grant
    12  applicants.    Such  modification  shall  account  for  any minimum wage
    13  adjustments. The commissioner shall promulgate any rules or  regulations
    14  necessary  to  ensure  grantees  shall serve at least the same number of
    15  students in any year that the rate per approved student increases.
    16    § 2. This act shall take effect immediately.
