       AN ACT to amend the administrative code of the  city  of  New  York,  in
         relation to scaffolding permit renewal
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The administrative code of the city of New York is  amended
    2  by  adding  a  new section 3314.20 to the New York city building code to
    3  read as follows:
    4    S 3314.20 SCAFFOLDING PERMIT RENEWAL. NO SCAFFOLDING PERMIT  SHALL  BE
    5  RENEWED  UNLESS  THE  COMMISSIONER  DETERMINES  THAT SUCH SCAFFOLDING IS
    6  BEING USED AS PART OF AN ONGOING CONSTRUCTION PROJECT.  IN  MAKING  SUCH
    7  DETERMINATION,  THE  COMMISSIONER  SHALL  CONDUCT  AN  INSPECTION OF THE
    8  CONSTRUCTION SITE FOR WHICH SUCH PERMIT RENEWAL IS SOUGHT. A  CONTRACTOR
    9  OR LICENSEE SHALL SUBMIT TO THE COMMISSIONER DOCUMENTATION IN SUPPORT OF
   10  PERMIT  RENEWAL  INDICATING  THE DATES AND TIMES PERSONS EMPLOYED IN THE
   11  CONSTRUCTION PROJECT HAVE UTILIZED THE SCAFFOLDING THAT IS  THE  SUBJECT
   12  OF  A  PERMIT  RENEWAL  REQUEST. A CONTRACTOR OR LICENSEE WHO SUBMITS OR
   13  CAUSES TO BE SUBMITTED DOCUMENTATION THAT CONTAINS FALSE  OR  MISLEADING
   14  STATEMENTS  SHALL  BE SUBJECT TO A CIVIL PENALTY NOT TO EXCEED ONE THOU-
   15  SAND DOLLARS.
   16    THE COMMISSIONER SHALL PROMULGATE SUCH RULES AND REGULATIONS AS MAY BE
   17  NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION.
   18    AN "ONGOING CONSTRUCTION PROJECT" SHALL MEAN ANY CONSTRUCTION  PROJECT
   19  DURING  WHICH  PERSONS  EMPLOYED IN CONSTRUCTION WORK ARE UTILIZING SUCH
   20  SCAFFOLDING AT LEAST TEN DAYS PER MONTH OVER  THE  COURSE  OF  THE  YEAR
   21  IMMEDIATELY PRECEDING A REQUEST TO RENEW A SCAFFOLDING PERMIT.
   22    S  2.  This  act shall take effect on the thirtieth day after it shall
   23  have become a law.
