       AN ACT to amend the education law, in relation to residency requirements
         for educational awards, grants, and loans
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Paragraphs a and b of subdivision 5 of section 661 of the
    2  education law, as amended by chapter  466  of  the  laws  of  1977,  are
    3  amended to read as follows:
    4    a. Except as provided in subdivision two of section six hundred seven-
    5  ty-four  OF  THIS  PART,  an applicant for an award at the undergraduate
    6  level of study must either (i) have been a legal resident of  the  state
    7  for  at least one year immediately preceding the beginning of the semes-
    8  ter, quarter or term of attendance for which application for  assistance
    9  is  made, or (ii) be a legal resident of the state and have been a legal
   10  resident during his OR HER last two  semesters  of  high  school  either
   11  prior  to  graduation,  or  prior to admission to college, OR (III) BE A
   12  MEMBER OF THE ARMED FORCES STATIONED IN NEW YORK OR HIS  OR  HER  DEPEN-
   13  DENTS  INCLUDING SPOUSE. Provided further that persons shall be eligible
   14  to receive awards under section six hundred sixty-eight or  section  six
   15  hundred sixty-nine OF THIS PART who are currently legal residents of the
   16  state and are otherwise qualified.
   17    b.  An  applicant  for  an  award  at the graduate level of study must
   18  either (i) have been a legal resident of the state for at least one year
   19  immediately preceding the beginning of the semester, quarter or term  of
   20  attendance  for  which  application for assistance is made, or (ii) be a
   21  legal resident of the state and have been a legal  resident  during  his
   22  last  academic  year  of  undergraduate study and have continued to be a
   23  legal resident until matriculation in the graduate program, OR (III)  BE
   24  A  MEMBER OF THE ARMED FORCES STATIONED IN NEW YORK OR HIS OR HER DEPEN-
   25  DENTS INCLUDING SPOUSE.
   26    S 2. This act shall take effect immediately.
