       AN  ACT to establish a task force on food, nutrition and physical educa-
         tion to investigate and establish appropriate and healthy  meal  plans
         and  physical education standards for New York city schools; making an
         appropriation therefor and providing for the repeal of such provisions
         upon expiration thereof
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. The commissioner of education is hereby directed to create
    2  a task force on food, nutrition and physical  education  to  investigate
    3  and  establish appropriate and healthy meal plans and physical education
    4  standards for New York city schools.
    5    S 2. The task force shall consist of 15 members and shall  be  chaired
    6  by  the commissioner of education or his designee. Five members shall be
    7  appointed by  the  commissioner  of  education;  two  members  shall  be
    8  appointed  upon  the recommendation of the chancellor of the city school
    9  district of New York; three members shall be appointed upon  the  recom-
   10  mendation  of  the  governor;  two  members  shall be appointed upon the
   11  recommendation of the speaker of the assembly; and two members shall  be
   12  appointed  upon  the  recommendation  of  the temporary president of the
   13  senate. The commissioner of education  may  invite  appropriate  ad  hoc
   14  representatives  from  other state and/or local agencies to serve on the
   15  task force. Vacancies on the task force shall be filled  in  the  manner
   16  provided for original appointments.

    1    S  3. The task force shall report its findings, conclusions and recom-
    2  mendations to the governor, temporary president of the  senate  and  the
    3  speaker of the assembly by September 1, 2011.
    4    S  4.  The  sum  of twenty-five thousand dollars ($25,000), or so much
    5  thereof as may be necessary, is hereby appropriated to the department of
    6  education from any moneys in the state treasury in the general  fund  to
    7  the credit of the state purposes account not otherwise appropriated, for
    8  its expenses in carrying out the provisions of this act.
    9    S  5.  This act shall take effect immediately and shall remain in full
   10  force and effect until  September  1,  2011  when  upon  such  date  the
   11  provisions of this act shall expire and be deemed repealed.
