        AN ACT to authorize and direct the commissioner of  education  to  study
          and  report on the effect the enhanced tuition award has on the growth
          rate and overall cost of tuition at New York's private institutions of
          higher learning
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  The  commissioner  of  education is hereby authorized and
     2  directed to conduct a study to determine if the enhanced tuition award's
     3  requirement that recipient's tuition rates be frozen  by  their  college
     4  has  an  effect  on non-recipient student's cost of attending college in
     5  New York.
     6    § 2. The study shall include the collection and analysis of data on:
     7    (a) tuition rates for all non-enhanced tuition award recipients as  an
     8  aggregate;
     9    (b) tuition rates for in-state non-enhanced tuition award recipients;
    10    (c) tuition rates for out-of-state students;
    11    (d) increases of related costs of attending college, such as:
    12    (i) textbooks from school owned stores;
    13    (ii) meal plans;
    14    (iii) cost of living on campus;
    15    (iv) room and board;
    16    (v) extracurricular fees;
    17    (vi) student fees;
    18    (vii) overall average cost increases other than tuition; and
    19    (viii)  any  other  fee  or  cost associated with attending college or
    20  university; and
    21    (e) tuition rate changes for all private colleges in New York state.

     1    § 3. The data collected under section two of this act shall  be  gath-
     2  ered  and  studied  over a 5 year timespan to ensure a minimal impact of
     3  market forces, economic shifts, or any other  major  factor  that  would
     4  alter the cost of attending private colleges in New York.
     5    §  4. Not later than 6 years after the effective date of this act, the
     6  commissioner of education shall conclude this study and submit a  report
     7  based on the study, including, but not limited to, any findings, results
     8  and recommendations, to each member of the legislature and the governor.
     9    § 5. This act shall take effect immediately.
