STATE OF NEW YORK ________________________________________________________________________ 2125 2019-2020 Regular Sessions IN ASSEMBLY January 22, 2019 ___________ Introduced by M. of A. ORTIZ -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to exempting full time active duty military members from certain fees and vehicle registration requirements The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 251-a to read as follows: 3 § 251-a. Exemption for members of the armed forces and their spouses. 4 1. The fees and requirements of this chapter in relation to drivers' 5 licenses, learners' permits, non-driver identification cards and the 6 registration of motor vehicles and motorcycles shall not apply to 7 members of the armed forces. Such exemption shall also apply to the 8 spouse of a member of the armed forces if such spouse is living outside 9 of the state of New York while the member is on active duty. 10 2. For purposes of this section "member of the armed forces" shall 11 mean a person on full time active duty in the army, navy, air force or 12 coast guard of the United States that is permanently domiciled in this 13 state, was administered his or her oath of military enlistment in this 14 state and is currently on active duty outside of the state of New York. 15 § 2. Subdivision 2 of section 251 of the vehicle and traffic law, as 16 amended by chapter 143 of the laws of 1968, is amended to read as 17 follows: 18 2. A member of the armed forces who has been issued a license to oper- 19 ate a motor vehicle or motorcycle by the armed forces of the United 20 States may operate a motor vehicle or motorcycle on the public highways 21 of this state without being licensed under this chapter for a period of 22 sixty days after such person has entered this state. When such person 23 applies to renew his or her license after entering this state, the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD06187-01-9A. 2125 2 1 person's photograph shall be taken to be included on the license pursu- 2 ant to regulations established by the commissioner. 3 § 3. This act shall take effect on the thirtieth day after it shall 4 have become a law. Effective immediately, the addition, amendment and/or 5 repeal of any rule or regulation necessary for the implementation of 6 this act on its effective date are authorized to be made and completed 7 on or before such effective date.
