ROSENTHAL, GOTTFRIED -- read once and referred to the Committee on Housing AN ACT to amend the administrative code of the city of New York, in relation to available information pertaining to rental histories of rent-stabilized units The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 26-516 of the administrative code of the city of 2 New York is amended by adding a new subdivision j to read as follows: 3 j. Complete rental histories for units regulated under this chapter 4 shall be made available by the state division of housing and community 5 renewal to local, county or state elected officials who submit an appli- 6 cation for such information under the provisions of the state freedom of 7 information law. Information shall be redacted as required under article 8 six of the public officers law, entitled the state freedom of informa- 9 tion law. Records obtained pursuant to this subdivision shall be used 10 solely for the purposes stated in the application. 11 § 2. Section 26-517 of the administrative code of the city of New York 12 is amended by adding a new subdivision h to read as follows: 13 h. Notwithstanding any other provision to the contrary, the state 14 division of housing and community renewal shall maintain rent histories 15 of units regulated under this chapter for a minimum of ten years. 16 § 3. Section 26-516 of the administrative code of the city of New York 17 is amended by adding a new subdivision k to read as follows: 18 k. The state division of housing and community renewal shall regulate 19 housing accommodations which, through a complaint, investigation, or 20 violation process, have been established to be illegally de-regulated 21 due to illegal use. For purposes of this section, illegal use shall 22 consist of, but not be limited to notices of illegal construction, ille- 23 gal conversion, illegal transient hotel, removal from rent rolls and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect immediately; provided that the amend- 4 ments to chapter 4 of title 26 of the administrative code of the city of 5 New York made by sections one, two and three of this act shall expire on 6 the same date as such law expires and shall not affect the expiration of 7 such law as provided under section 26-520 of such law.
