        AN ACT approving land transactions relating to the implementation of the
          land  exchange  for the forest preserve health and safety land account
          and public utility improvements
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. Pursuant to section 1 of article 14 of the State Constitu-
     2  tion, as amended at the general election held  in  November,  2017,  the
     3  legislature  approves the lands to be conveyed to the State as described
     4  in section three of this act, which adds in excess of the  required  250
     5  acres  to  the  forest preserve necessary to allow the use of the forest
     6  preserve health and safety account for projects authorized  pursuant  to
     7  title 21 of article 9 of the environmental conservation law.
     8    § 2. Title to the land described in section three of this act shall be
     9  approved  by  the  attorney  general, and the deeds to the people of the
    10  state of New York of such described  lands  shall  be  approved  by  the
    11  attorney general as to the form and manner of execution and recordabili-
    12  ty  prior  to  its  delivery  to  the respective county clerk office for
    13  recording.
    14    § 3. The lands to be conveyed to the state are described  as  follows:
    15  ALL  THOSE  CERTAIN PIECES OR PARCELS OF LAND situate lying and being in
    16  the Town of Olive, Ulster County and in the Town of Moriah, Essex County
    17  and State of New York being generally described as Ulster  County,  Town
    18  of  Olive  Tax  Parcels  45.1-1-1.212  and  45.1-1-1.331,  consisting of
    19  approximately 214 acres of land and as Essex County, Town of Moriah  Tax
    20  Parcels  96.3-1-21.001, 106.00-1-1.1, 106.00-1-2, 106.00-1-3, 106.00-1-4
    21  and 106.00-1-22, consisting of approximately 1206 acres  of  land,  said
    22  parcels being more specifically described to wit:

     1    ALL  THAT  PIECE OR PARCEL OF LAND SITUATE LYING AND BEING in the Town
     2  of Olive, County of Ulster and State of  New  York,  being  bounded  and
     3  described as follows:
     4    BEGINNING at a point in the center of Watson Hollow Road (County Route
     5  42)  at  the westerly corner of lands now or formerly of Lisa Hubbard as
     6  described in Liber 4214 of deeds at page 47, and runs thence along  said
     7  lands South 48°44'45" East 494.90 feet to a found rebar set in a pile of
     8  stones  on  the  westerly  boundary of lands now or formerly of Denis J.
     9  Moran & Judith A. Moran as described in Liber 554 of deeds at page  335,
    10  said  last  mentioned  course at distances of 20.00 feet and 250.00 feet
    11  passes through 5/8 inch diameter rebars with  a  plastic  cap  inscribed
    12  "Brooks  & Brooks---Property Line" set, thence along said lands of Moran
    13  the following five courses and distances:
    14    1) South 22°11'37" West 270.37 feet to a found 1/2 inch diameter metal
    15  pipe set at the northerly end of a stone wall,
    16    2) along said wall South 03°12'32" East 220.04 feet to  a  cornered  8
    17  inch diameter Birch tree,
    18    3) South 42°52'59" East 198.81 feet to a found 2 foot diameter pile of
    19  stones,
    20    4)  South  38°10'19"  East  433.80 feet to a found stone on end in a 2
    21  foot diameter pile of stones and
    22    5) South 25°58'16" East 1,179.61 feet to a found 2 foot diameter  pile
    23  of  stones at the northwesterly corner of lands of the State of New York
    24  as described in Liber 551 of deeds at page 573, thence along said  lands
    25  of  the  State of New York South 26°19'42" East 659.82 feet to a found 4
    26  foot diameter pile of stones, thence continuing along said lands of  the
    27  State  of  New York South 57°23'00" West 1,099.28 feet to a found 5 foot
    28  diameter pile of stones at the southeasterly  corner  of  lands  now  or
    29  formerly of Corrine E. Lopez as described in Liber 5198 of deeds at page
    30  248, thence along said lands the following two courses and distances:
    31    1)  North  37°59'13"  West  2,528.23 feet to a 5/8 inch diameter rebar
    32  with a plastic cap inscribed "Brooks & Brooks" in a pile of stones to be
    33  set and
    34    2) North 02°14'19" East 150.00 feet to the center of the Bush Kill  in
    35  the southeasterly line of lands now or formerly of Margaret & Rijk Riet-
    36  veld  as  described  in  Liber  3797  of  deeds  at  page 221, said last
    37  mentioned course at a distance of 105.67 feet passes through a 5/8  inch
    38  diameter rebars with a plastic cap inscribed "Brooks & Brooks---Property
    39  Line"  set,  thence  along  said  lands  the  following  two courses and
    40  distances:
    41    1) Along the center of said Kill North 33°14'19" East 149.00 feet to a
    42  point and
    43    2) North 42°18'27" West 440.37 feet  to  the  center  of  said  Watson
    44  Hollow Road said last mentioned course at a distance of 47.3 feet passes
    45  through  a  found  rebar  and  a distance of 414.2 feet passes through a
    46  found metal pipe,
    47  thence along the center of said road North 43°06'00" East 50.16 feet  to
    48  a  northwesterly  corner of lands now or formerly of Amanda C. Insall as
    49  described in Liber 5681 of deeds at page 86, thence along said lands the
    50  following four courses and distances:
    51    1) South 42°18'27" East 430.18 feet to the center of said  Bush  Kill,
    52  said  last  mentioned  course  at a distance of 26.0 feet and 390.4 feet
    53  passes through found rebars,
    54    2) The remaining four courses and distances being along the center  of
    55  said Kill North 31°49'38" East 86.57 feet,
    56    3) North 39°53'17" East 80.20 feet and

     1    4)  North  45°37'33"  East  192.47 feet to the southwesterly corner of
     2  lands now or formerly of R. Todd Green and Amie M.   Green as  described
     3  in  Liber 5652 at page 104, thence along said lands, along the center of
     4  said Kill the following five courses and distances:
     5    1) North 59°48'03" East 141.90 feet,
     6    2) North 64°39'25" East 92.25 feet,
     7    3) North 50°04'04" East 66.80 feet,
     8    4) North 43°32'40" East 126.57 feet and
     9    5) North 18°42'39" East 242.58 feet,
    10  thence leaving the said Kill continuing along said lands of Green, North
    11  50°35'36"  West  313.44  feet  to the center of said Watson Hollow Road,
    12  said last mentioned course at a distance of 39.4 feet passes  through  a
    13  found  rebar  and  at  a  distance  of 284.7 feet passes through a found

    28  Brooks  &  Brooks,  Land  Surveyors,  P.C.,  filed in the County Clerk's
    29  Office on July 19th 2017 as map number 17-131 A and 17-131 B,  said  lot
    30  being bounded and described as follows:
    31    BEGINNING  at  a  point  in  the center of the County Highway known as
    32  Watson Hollow Road (County Route 42) in the northeasterly line of  lands
    33  now  or formerly of Jean Marie Duffy as described in Liber 5304 of deeds
    34  at page 286 and runs thence from said point of beginning along said land
    35  of Duffy generally along the center of a stone wall the  following  five

    43  1202 of deeds at page 246 marked by a set 5/8 inch diameter rebar with a
    44  "Brooks  & Brooks" plastic cap set at the northeast end of a stone wall,

    46  West 2,841.36 feet to the southeasterly line of lands now or formerly of
    47  Frank  L. Parslow as described in Liber 5269 of deeds at page 328 marked
    48  by a found pile of stones on a large  rock,  thence  along  said  lands,

     9    4.  South  44°49'02" East 550.90 feet to the westerly corner of a 6.56
    10  acre lot as shown on the above referenced filed map marked by a set  5/8
    11  inch  diameter  rebar  with a "Brooks & Brooks" plastic cap in a pile of
    12  stones, thence along said 6.56 acre lot, generally along a  blazed  line

    16    2. South 49°44'29" East 228.73 feet to the  center  of  the  aforemen-
    17  tioned  Watson  Hollow Road, said last mentioned course at a distance of
    18  203.73 feet passes through a set 5/8 inch diameter rebar with a  "Brooks
    19  &  Brooks"  plastic  cap,  thence  along  the  center of said road South
    20  43°06'00" West 100.12 feet to the point of beginning.
    21    CONTAINING One hundred twenty and twelve hundredths (120.12) acres.
    22    BEARINGS are with reference to Ulster County filed map  number  11610,
    23  Magnetic North 2009.
    24    ALSO ALL THAT PIECE OR PARCEL OF LAND SITUATE LYING AND BEING Lot 363,
    25  Paradox  Tract,  Town  of  Moriah, County of Essex and State of New York
    26  located on the southerly side of Ensign Pond Road  (and  also  known  as
    27  County Route 4):
    28    BEGINNING  at  a  point  located in the northeast corner of the parcel
    29  being herein conveyed and said point being in the center of  the  Ensign
    30  Pond Road proceeding South 09°23'51" West 25 feet to an iron rod, thence
    31  proceeding  South 09°23'51" West 866.05 feet to a drill hole and plug on
    32  a ledge marker with stones and being the southeast corner of the  parcel
    33  herein,  thence  proceeding North 81°02'03" West 1044.36 feet to a drill
    34  hole and plug on a ledge marked with iron and  stones  and  marking  the
    35  southwest corner of the parcel herein, thence proceeding North 10°55'50"
    36  East  917  feet more or less to a point in the center of the Ensign Pond
    37  Road, thence proceeding along the center line of Ensign Pond Road as  it
    38  winds  and  turns 1075 feet more or less to the point or place of begin-
    39  ning.
    40    CONTAINING Twenty one and fifty seven hundredths (21.57) acres.
    41    BEARINGS are with reference to Survey dated January 28, 1983 by Martin
    42  B. Thompson, Land Surveyor.
    43    ALSO ALL THAT PIECE OR PARCEL  OF  LAND  SITUATE  LYING  AND  BEING  a
    44  portion  of Lots 363 and 364 and all of Lots 345, 344, 317, 328, 318 and
    45  327 of the Paradox Tract in the Town of  Moriah,  County  of  Essex  and
    46  State of New York and being described as follows:
    47    BEGINNING  in  the  center  of  the  Essex County Highway Route 4, the
    48  Ensign Pond Road, at the westerly bounds of  lands  reputedly  owned  by
