LOPEZ, McDONOUGH, RAIA, THIELE -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend chapter 154 of the laws of 1921, relating to the port authority of New York and New Jersey, in relation to the commissioners of such authority The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Article 4 of section 1 of chapter 154 of the laws of 1921, 2 relating to the port authority of New York and New Jersey, as amended by 3 chapter 419 of the laws of 1930, is amended to read as follows: 4 ARTICLE IV 5 The port authority shall consist of twelve commissioners, six resident 6 voters from the state of New York, [at least] four of whom shall be 7 resident voters of the city of New York, one of whom shall be a resident 8 voter from either the county of Dutchess, Orange, Putnam, Rockland, 9 Sullivan, Ulster or Westchester and one of whom shall be a resident 10 voter from either the county of Nassau or Suffolk, and six resident 11 voters from the state of New Jersey, at least four of whom shall be 12 resident voters within the New Jersey portion of the district, the New 13 York members to be chosen by the state of New York and the New Jersey 14 members by the state of New Jersey in the manner and for the terms fixed 15 and determined from time to time by the legislature of each state 16 respectively, except as herein provided. Each commissioner may be 17 removed or suspended from office as provided by the law of the state 18 from which he shall be appointed. 19 § 2. Subdivision 1 of article 4 of section 1 of chapter 154 of the 20 laws of 1921, relating to the port authority of New York and New Jersey, 21 as amended by chapter 559 of the laws of 2015, is amended to read as 22 follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The port authority shall consist of twelve commis- 2 sioners, six resident voters from the state of New York, [at least] four 3 of whom shall be resident voters of the city of New York, one of whom 4 shall be a resident voter from either the county of Dutchess, Orange, 5 Putnam, Rockland, Sullivan, Ulster or Westchester and one of whom shall 6 be a resident voter from either the county of Nassau or Suffolk and six 7 resident voters from the state of New Jersey, at least four of whom 8 shall be resident voters within the New Jersey portion of the district, 9 the New York members to be chosen by the state of New York and the New 10 Jersey members by the state of New Jersey in the manner and for the 11 terms fixed and determined from time to time by the legislature of each 12 state respectively, except as herein provided. Each commissioner may be 13 removed or suspended from office as provided by the law of the state 14 from which he shall be appointed. 15 § 3. Sections one and two of this act shall take effect upon the 16 enactment into law by the state of New Jersey of legislation having an 17 identical effect with this act, but if the state of New Jersey shall 18 have already enacted such legislation, section one of this act shall 19 take effect immediately; provided, however, if chapter 559 of the laws 20 of 2015 shall not have taken effect on or before such date then section 21 two of this act shall take effect on the same date and in the same 22 manner as such chapter of the laws of 2015 takes effect; provided that 23 the state of New Jersey shall notify the legislative bill drafting 24 commission upon the occurrence of the enactment of the legislation 25 provided for in sections one and two of this act in order that the 26 commission may maintain an accurate and timely effective data base of 27 the official text of the laws of the state of New York in furtherance of 28 effectuating the provisions of section 44 of the legislative law and 29 section 70-b of the public officers law.
