          Committee on Environmental Conservation

        AN ACT to direct the department of environmental conservation  to  adopt
          rules  and  regulations  requiring  permittees to place air monitoring
          equipment near permitted waste transfer stations

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  No later than January 1, 2023, the department of environ-
     2  mental conservation shall adopt rules and regulations requiring  permit-
     3  tees  to  conduct  continuous  air monitoring to measure data for sulfur
     4  dioxide, oxides of nitrogen, carbon dioxide, meteorological data, PM 1.0
     5  and PM 2.5.  Such regulations shall also require that for each pollutant
     6  monitors utilized are designated as federal reference methods or federal
     7  equivalent methods, as applicable, in accordance with 40  CFR  Part  53;
     8  are  continuously-recording types, if available; and that the number and
     9  locations of monitors shall be  adequate  to  detect  pollution  concen-
    10  tration  gradients  of  emissions  from  operation  of the facility that
    11  affect publicly accessible areas near the facility.
    12    The number and locations of  monitors  shall  be  adequate  to  detect
    13  pollution  concentration  gradients  of  emissions from operation of the
    14  waste transfer stations that affect nearby publicly accessible areas.
    15    Resulting air quality data shall be required to be made  available  to
    16  the  department  of environmental conservation and the public and posted
    17  on the department's website.
    18    § 2. This act shall take effect one year after it shall have become  a
    19  law.
