ENGLEBRIGHT -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting certain uses of trichloroethylene; and to amend a chapter of the laws of 2020, amending the environmental conservation law relating to prohibiting certain uses of trichloroethylene, as proposed in legislative bills numbers S. 6829-B and A. 8829-A, in relation to the effectiveness thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 37-0119 of the environmental conservation law, as 2 added by a chapter of the laws of 2020, amending the environmental 3 conservation law relating to prohibiting certain uses of trichloroethy- 4 lene, as proposed in legislative bills numbers S. 6829-B and A. 8829-A, 5 is amended to read as follows: 6 § 37-0119. Prohibition against certain uses of trichloroethylene. 7 1. [Beginning December first, two thousand twenty-one, no] No person 8 shall use trichloroethylene as a vapor degreaser, an intermediate chemi- 9 cal to produce other chemicals, a refrigerant, or an extraction solvent 10 or in any other manufacturing or industrial cleaning process or use. 11 2. For purposes of this section: 12 (a) "Extraction solvent" means a solvent used to separate a specific 13 substance from a mixture. 14 (b) "Refrigerant" means a chemical that is used as a heat carrier in a 15 cooling mechanism and that changes from liquid to gas and back again in 16 the refrigeration cycle. 17 (c) "Trichloroethylene" means a chemical with the Chemical Registry 18 Abstract Services Number of 79-01-6. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD07192-01-1A. 953 2 1 (d) "Vapor degreaser" means a substance boiled to a vapor that 2 condenses onto metal parts, causing beading and dripping, and that 3 removes contaminants from the parts. 4 3. Severability. The provisions of this section shall be severable and 5 if any portion thereof or the applicability thereof to any person or 6 circumstance is held invalid, the remainder of this section and the 7 application thereof shall not be affected thereby. 8 § 2. Section 2 of a chapter of the laws of 2020, amending the environ- 9 mental conservation law relating to prohibiting certain uses of trichlo- 10 roethylene, as proposed in legislative bills numbers S. 6829-B and A. 11 8829-A, is amended to read as follows: 12 § 2. This act shall take effect [immediately] December 1, 2022. 13 § 3. This act shall take effect immediately; provided, however, 14 section one of this act shall take effect on the same date and in the 15 same manner as a chapter of the laws of 2020, amending the environmental 16 conservation law relating to prohibiting certain uses of trichloroethy- 17 lene, as proposed in legislative bills numbers S. 6829-B and A. 8829-A, 18 takes effect.
