STATE OF NEW YORK ________________________________________________________________________ 448 2021-2022 Regular Sessions IN ASSEMBLY (Prefiled) January 6, 2021 ___________ Introduced by M. of A. ROZIC -- read once and referred to the Committee on Labor AN ACT to amend the labor law, in relation to extending the statute of limitations relating to a civil action by an employee who has been the subject of a retaliatory personnel action The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 4 of section 740 of the labor 2 law, as added by chapter 660 of the laws of 1984, is amended to read as 3 follows: 4 (a) An employee who has been the subject of a retaliatory personnel 5 action in violation of this section may institute a civil action in a 6 court of competent jurisdiction for relief as set forth in subdivision 7 five of this section within [one year] two years after the alleged 8 retaliatory personnel action was taken. 9 § 2.
