STATE OF NEW YORK ________________________________________________________________________ 178--A 2015-2016 Regular Sessions IN ASSEMBLY (Prefiled) January 7, 2015 ___________ Introduced by M. of A. GANTT -- read once and referred to the Committee on Education -- recommitted to the Committee on Education in accord- ance with Assembly Rule 3, sec. 2 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee AN ACT in relation to the transportation of students in the Rochester city school district The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. a. Notwithstanding the provision of any law, rule, or regu- 2 lation to the contrary, including subdivision 1 of section 3635 of the 3 education law, the city school district of the city of Rochester, upon 4 approval of a vote by the board of education of a plan which describes 5 fiscal and educational outcomes and implementation strategy and notifi- 6 cation to the commissioner of education by February 1, 2017, may enter 7 into a transportation pilot program for a period not to exceed five 8 school years beginning with the 2017-2018 school year to provide trans- 9 portation services for children attending grades kindergarten through 3 10 in the 2017-2018 school year, and for children attending kindergarten 11 through 6 in the 2018-2019 school year and subsequent years, and who 12 live more than one-half mile and less than fifteen miles from the school 13 which they legally attend provided such transportation, if offered, 14 shall be offered equally to all children in like circumstances residing 15 in the district. 16 b. For the purposes of computing approved transportation expenses for 17 transportation aid for transportation provided under this pilot program, 18 expenses for transportation provided pursuant to this pilot program for 19 children attending grades kindergarten through 3 in the 2017-2018 school 20 year, and for children attending kindergarten through 6 in the 2018-2019 21 school year and subsequent years, who live more than one-half mile and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD03177-02-6A. 178--A 2 1 less than fifteen miles from the school which they legally attend shall 2 be included. Transportation expenses shall be reimbursed pursuant to 3 subdivision 7 of section 3602 of the education law during such pilot 4 period in an amount not to exceed the 2016-2017 approved transportation 5 aid amount pursuant to such subdivision 7. 6 c. In the event costs for providing transportation for children that 7 would otherwise be aidable without this pilot program increase due to 8 enrollment changes or other customary increases in cost as defined in 9 regulation by the commissioner of education, the city school district of 10 the city of Rochester may apply to the commissioner of education for a 11 waiver to receive additional transportation aid in excess of the 12 2016-2017 transportation aid amount during the pilot program for 13 services that would otherwise be allowable transportation expenses. 14 d. The city school district of the city of Rochester shall provide a 15 report to the commissioner of education on the results of the first four 16 years of the pilot program, including data that describes the costs and 17 benefits of the program, by September 30, 2021. 18 § 2. This act shall take effect immediately.
