       AN ACT to amend the civil practice law and rules, in relation to  enact-
         ing the "civil practice medical records production act"
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Short title. This act shall be known and may  be  cited  as
    2  the "civil practice medical records production act".
    3    S  2.  Subdivision  (c)  of section 8001 of the civil practice law and
    4  rules is amended to read as follows:
    5    (c)  [Transcripts]  PRODUCTION  of  PAPER  records  AND/OR  DOCUMENTS.
    6  [Wherever]  NOTWITHSTANDING  ANY OTHER PROVISION OF LAW RELATING TO FEES
    7  FOR THE PRODUCTION OF PAPER RECORDS AND/OR DOCUMENTS WHENEVER the [prep-
    8  aration of a transcript] PRODUCTION of PAPER records AND/OR DOCUMENTS is
    9  required in order to comply with a subpoena, the person subpoenaed shall
   10  receive an additional fee of ten cents per [folio] PAGE upon demand,  IN
   11  ADDITION  TO  ANY  SUCH  ATTENDANCE FEE AND/OR TRAVEL EXPENSES WHICH THE
   12  PERSON SUBPOENAED MIGHT BE ELIGIBLE TO RECEIVE FOR THEIR ACTUAL  ATTEND-
   13  ANCE.
   14    S 3. This act shall take effect immediately.
