A Concurrent Resolution overriding a line-item veto of a language provision in the General Provisions of the Fiscal Year 2012 appropriation act imposing restrictions on the Comprehensive Medicaid Waiver sought by the State.

 

     Be It Resolved by the Senate of the State of New Jersey (the General Assembly concurring):

 

     1.    That the following language provision, on page 263 of Senate Bill No. 4000 of 2011 (P.L.2011, c.85) which was the subject of objection by the Governor in the Governor's veto statement of June 30, 2011, be restored to law as follows, the objections thereto of the Governor notwithstanding:

 

GENERAL PROVISIONS

     83.  Notwithstanding any provision of law or regulation to the contrary, the comprehensive Medicaid waiver submitted by the State to the U.S. Department of Health and Human Services= Centers for Medicare and Medicaid Services, or any agreement entered into pursuant to that waiver, shall not include any restrictions on the expenditure of amounts hereinabove appropriated that reduce eligibility for services based on financial criteria, reduce provider reimbursement rates, impose any new or increased co-payments for clients, limit the amount, duration or scope of services, or limit the total amount of State Medicaid expenditures or federal reimbursements.

 

     2.    BE IT FURTHER RESOLVED, that copies of this resolution be delivered to the Governor, the State Treasurer, and the Commissioner of Human Services.

 

 

STATEMENT

 

     This resolution restores the integrity of a language provision in the Fiscal Year 2012 appropriations act that the Governor revised by a line-item veto.  The language seeks to ensure that the Comprehensive Medicaid Waiver sought by the State will not include a reduction in eligibility for services based on financial criteria; a reduction in provider reimbursement rates; an imposition of any new or increased co-payments for clients; a limit on the amount, duration or scope of services; or a limit on the total amount of State Medicaid expenditures or federal reimbursements.  Absent this language, the waiver request may include all these changes. 

     The New Jersey Department of Human Services is looking to achieve $300 million in cost savings in the administration of the Medicaid program and the Children's Health Insurance Program (CHIP) in FY 2012.  Before the department can pursue any implementing measures, however, the United States Department of Health and Human Services must waive applicable federal Medicaid and CHIP provisions.  Accordingly, the State has submitted a so-called Section 1115 research and demonstration waiver application requesting permission to pursue various cost containment strategies and administrative reforms.
