SYNOPSIS
Requires Attorney General to establish victims of identity theft database.

An Act concerning victims of identity theft and supplementing Title 2C of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. The Attorney General shall establish and maintain a database of persons who have been victims of identity theft. Access to information in the database shall be limited to law enforcement agencies, victims of identity theft, and persons and agencies authorized by the victims of identity theft.
b. In order to be included in the database established under subsection a. of this section, a victim shall submit to the Attorney General:
(1) a copy of any report filed with a local law enforcement agency, pursuant to the provisions of section 3 of P.L.2005, c.226 (C.2C:21-17.6) or the Federal Trade Commission;
(2) a copy of any court order obtained in relation to the claim of identify theft, if any order has been issued; and
(3) any other information prescribed by the Attorney General.
2. This act shall take effect on the first day of the seventh month next following enactment, except the Attorney General may take any anticipatory action in advance thereof as shall be necessary for the implementation of this act.
STATEMENT
This bill requires the Attorney General to establish and maintain a database of persons who have been victims of identity theft. Under the provisions of the bill, access to information in the database will be limited to law enforcement agencies, victims of identity theft, and persons and agencies authorized by the victims of identity theft.
In order to be included in the database, the bill requires a victim to submit to the Attorney General:
(1) a copy of any report filed with a local law enforcement agency or the Federal Trade Commission related to the claim identity theft;
(2) a copy of any court order obtained in relation to the claim of identify theft, if any order has been issued; and
(3) any other information prescribed by the Attorney General.
This information in the database may be used by victims in order to establish to credit reporting agencies and other entities that they have had their identities stolen. Additionally, the information may be used to assist law enforcement agencies in the ongoing investigation of identity theft.
