SYNOPSIS
Prohibits use of open public records act for mailers and advertisements.

An Act prohibiting the use of the open public records act for mailers and advertisements and supplementing P.L.1963, c.73 (C.47:1A-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. At no time shall information obtained from a government records request, as defined in P.L.1963, c.73 (C.47:1A-1 et seq.), be used for marketing, advertising, or promotional business activities, for the promotion or offer of a product or service, or for any substantially similar purpose by a non-governmental entity, except as may be specifically permitted by law or regulation.
b. Any person found guilty of violating any of the provisions of this section of law, P.L. , c. (C. )(pending before the Legislature as this bill), shall be guilty of a petty disorderly persons offense.
2. This act shall take effect immediately.
STATEMENT
This bill prohibits the use of the open public records act for mailers and advertisements. Under the bill, information obtained from a government records request cannot be used for marketing, advertising, or promotional business activities, for the promotion or offer of a product or service, or for any substantially similar purpose by a non-governmental entity, except as may be specifically permitted by law or regulation.
Any person found guilty of violating this provision will be guilty of a misdemeanor.
