SYNOPSIS

     Requires State Board of Education to provide five days' notice of public meeting and permit public comment on agenda items of public meeting.

An Act concerning State Board of Education meetings and amending N.J.S.18A:4-7. 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    N.J.S.18A:4-7 is amended to read as follows:

     18A:4-7.     The [state board] State Board of Education shall hold public meetings at least once in each month at such times as its rules may prescribe and at such other times and such places within the [state] State as in its judgment may be necessary, but no meeting shall commence later than eight P.M.

     Notwithstanding section 4 of P.L.1975, c.231 (C.10:4-9), adequate notice of a public meeting of the State Board of Education shall be provided at least five days in advance of the meeting date. 

     For any public meeting, members of the public shall be permitted to make comments for each item on the meeting agenda that is not addressed in executive session pursuant to section 7 of P.L.1975, c.231 (C.10:4-12).

     2.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill requires the State Board of Education to provide a minimum of five days' notice of a public meeting of the board.  The bill also requires that members of the public be permitted to provide public comment on all agenda items of a public meeting that are not addressed in executive session.

     Under current law, adequate notice of 48 hours is required before a public meeting of the State Board of Education.     This bill extends that required notice to a minimum of five days.
