An Act concerning reproductive rights and supplementing Title 26 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  1[The Department] a.  As used in this act, "reproductive health care services" means all medical, surgical, counseling, or referral services relating to the human reproductive system including, but not limited to, services relating to pregnancy, contraception, or termination of a pregnancy.

     b.    No later than 180 days after the effective date of this act, the Commissioner1 of Health 1, 2in consultation with the Attorney General,2 the Commissioner of Banking and Insurance, the Commissioner of Human Services, and the State Treasurer1 2,2 shall 1[create a new] 2[jointly establish an1] provide on the Department of Health's2 Internet website 1[with] 2[, which shall have a unique uniform resource locator (URL) and be separate from the Internet websites of the Department of Health, the Department of Banking and Insurance, the Department of Human Services, and the Department of the Treasury Internet websites, providing1]2 comprehensive information on 1[women's]1 reproductive rights under 2[federal and]2 State law 1[and under health insurance plans] , as well as information concerning health benefits coverage for reproductive health care services1 , which 1information1 shall include, but 1[may] shall1 not be limited to 1, information concerning1

     1(1)1 the right 2under State law2 to 1access and receive1 emergency 1reproductive health1 care 1services1 ;

     1(2)1  the right 2under State law2 to 1[birth control] access and use contraception, including, but not limited to, condoms, diaphragms, spermicides, contraceptive vaginal rings, transdermal contraceptive patches, contraceptive hormonal injections, hormonal contraceptive pills, uterine implants, intrauterine devices, and surgical and non-surgical sterilization1 ;

     1(3)  the right 2under State law2 to self-determination regarding the use of contraception and the right 2under State law2 to refuse sterilization;

     (4)1  the right 2under State law2 to 1[medication] access and use prescription and non-prescription medications for reproductive health care1 ;

     1(5)1  the right 2under State law2 to 1carry a pregnancy to term and the right 2under State law2 to terminate a pregnancy, as well as the right to1 access 1[abortion]1 services 1necessary for childbirth and abortion care1 ;

     1(6)1  the right 2under State law2 to access preventative 1reproductive1 health care services; 

     1(7)1  the right 2under State law2 to 1[health care for the uninsured, which shall include hyperlinks to websites that register the uninsured for health care benefits] receive reproductive health care services regardless of insurance status, which information shall include links to appropriate Internet websites and other resources that can provide assistance in enrolling individuals without insurance or who are underinsured in a health benefits plan or to apply for medical assistance under the Medicaid or NJ FamilyCare programs;

     (8)   a resource page, or a link to a resource website, where patients can locate current, verified reproductive health care providers, including abortion care providers1 ; and

     1(9)1  information on where and how to file a complaint in the event that 1[a woman's] an individual's1 reproductive rights are violated.

     1c.   The information provided on or through the Internet website established pursuant to subsection b. of this section 2[shall] may2 be made available 2[, to the extent possible, in the 10 languages most commonly spoken in New Jersey, and, at the discretion of the commissioners and the State Treasurer,]2 in such additional languages as 2[they deem] deemed2 appropriate 2by the Commissioner of Health2.

     2[d.  In the event the Internet website required to be established pursuant to subsection b. of this section is not established within 180 days after the effective date of this act, the Commissioner of Health, the Commissioner of Banking and Insurance, the Commissioner of Human Services, and the State Treasurer shall appear before the committee of first reference in which this act was considered in each House, or before another standing reference committee in the General Assembly as may be determined by the Speaker of the General Assembly and in the Senate as may be determined by the President of the Senate, to explain why this act has not been implemented in accordance with its provisions, and the steps the commissioners and the State Treasurer are taking to ensure implementation of this act.  Thereafter, for such time as the Internet website required pursuant to subsection b. of this section remains unestablished, the Speaker of the General Assembly shall have the authority to require the commissioners and the State Treasurer to appear before any appropriate General Assembly standing reference committee to explain why this act has not been implemented in accordance with its provisions and the steps that are being taken to ensure the implementation of this act, and the President of the Senate shall have the authority to require the commissioners and the State Treasurer to appear before any appropriate Senate standing reference committee to explain why this act has not been implemented in accordance with its provisions and the steps that are being taken to ensure the implementation of this act.1]2

 

      1[2.  The Commissioner of Health shall adopt rules and regulations, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), as necessary to implement the provisions of this act.]1

 

     1[3.] 2.1     This act shall take effect 2[immediately] 180 days after the date of enactment2.
