SYNOPSIS

     Authorizes bonus credits toward fair share affordable housing obligation for transitional housing occupied by veterans.

An Act concerning credit toward fair share housing obligation for certain transitional housing and supplementing P.L.1985, c.222 (C.52:27D-301 et al.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding any limitation on the percentage of a municipality's fair share obligation that may be satisfied through bonus credits, the municipality shall receive one unit of credit and one-half bonus credit for each unit of transitional housing that is occupied or reserved for occupancy by a low or moderate income veteran with active service in time of war, as defined in section 1 of P.L.1963, c.171 (C.54:4-8.10).

     b.    For purposes of this section, "transitional housing" means housing with on-site or off-site supportive services that facilitate the movement of individuals and families, who are homeless or lack stable housing to permanent housing, within a fixed amount of time, generally up to 24 months.  Each unit of transitional housing occupied or reserved for occupancy in accordance with the requirements of subsection a. of this section shall be subject to affordability controls for not less than 10 years.

 

     2.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill would allow municipalities to obtain bonus credit toward the fulfillment of their fair share affordable housing obligations for transitional housing reserved for certain veterans. This bill would allow a municipality to receive one unit of credit and one-half bonus credit toward a municipality's fair share obligation for each unit of transitional housing occupied, or reserved for occupancy, by a veteran of low or moderate income who had active service in time of war, as defined in current law.  The bill would allow these bonus credits to apply regardless of any limitation on the percentage of a municipality's fair share obligation that may be satisfied through bonus credits.
