SYNOPSIS

     Requires owner of railroad bridge to submit bridge inspection records to DOT.

An Act concerning certain bridge inspection records and supplementing Title 48 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  Notwithstanding the provisions of any law, rule, or regulation to the contrary, a railroad company owning, leasing, or controlling the right-of-way for a bridge in this State shall annually submit a report to the Commissioner of Transportation including the following information:

     (1) a copy of any bridge inspection report completed pursuant to federal or State law in the preceding 12 months;

     (2) a copy of the bridge inspection standards used to complete the inspection;

     (3) a copy of the bridge management program, adopted pursuant to 49 C.F.R. s.237.31 and 49 C.F.R. s.237.33, or a certification that the bridge management program submitted during the prior annual reporting period is still valid; and

     (4) a certification by a bridge engineer that the bridge is able to carry the loads that travel the bridge on a daily basis.

     b.  The report required pursuant to subsection a. of this section shall be submitted by the railroad company to the Commissioner of Transportation, in a manner prescribed by the commissioner, within 180 days of the effective date of P.L    , c.   (C.       ) (pending before the Legislature as this bill) and annually thereafter.  

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires railroad companies owning, leasing, or controlling the right-of-way for bridges in this State to annually submit to the Commissioner of Transportation: a copy of any bridge inspection report completed pursuant to federal or State law in the preceding 12 months; the bridge inspection standards used to complete the inspection; a copy of the bridge management program adopted by the railroad pursuant to federal regulations; and a certification by a bridge engineer that the bridge is able to carry the loads that travel the bridge on a daily basis.
