An Act concerning automated teller machines and amending P.L.1995, c.117.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 3 of P.L.1995, c.117 (C.17:16K-9) is amended to read as follows:

     3.    a.  Every automated teller machine facility shall contain a video camera which at least shall view and record all persons entering the facility or all persons who effect a transaction.

     b.    Where 9-1-1 or E-9-1-1 service is available, an automated teller machine shall contain a dedicated voice telephone line operable by a single switch that establishes an immediate connection to the available  9-1-1 or  E-9-1-1 emergency service. The switch shall be activated through the use of an automated teller machine access device.

     c.     Each automated teller machine shall have displayed, in a conspicuous place, a warning notice that any person who knowingly makes a false alarm or places a call through the 9-1-1 or E-9-1-1 emergency telephone system without the purpose of reporting the need for 9-1-1 or E-9-1-1 service may be subject to prosecution for a criminal offense, which may be punishable by fine or imprisonment or both, and may also be subject to civil penalty.

     2.    This act shall take effect on the 365th day after enactment.

 

 

STATEMENT

 

     This bill requires automated teller machine (ATM) locations to contain a dedicated voice telephone line operable by a single switch that establishes an immediate connection to 9-1-1 or E-9-1-1 emergency service, where that service is available, and requires that the switch be activated through the use of an automated teller machine access device.  In addition, the bill provides that each automated teller machine shall have displayed, in a conspicuous place, a warning notice that any person who knowingly makes a false alarm or places a call through the 9-1-1 or E-9-1-1 emergency telephone system without the purpose of reporting the need for 9-1-1 or E-9-1-1 service may be subject to prosecution for a criminal offense, which may be punishable by fine or imprisonment or both, and may also be subject to civil penalty.
