SYNOPSIS
Increases fines for failing to have required markings on commercial vehicles.
CURRENT VERSION OF TEXT

An Act concerning markings on certain commercial vehicles and amending R.S.39:4-47.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. R.S.39:4-47 is amended to read as follows:
39:4-47. a. A person violating [this article] subsection a. of R.S.39:4-46 shall be fined [not more than ten dollars ($10.00).] as follows:
(1) $250 for a first offense;
(2) $500 for a second offense; and
(3) $1,000 for a third or subsequent offense.
b. In default of the payment [thereof he] required in subsection a. of this section, the person shall be imprisoned in the county jail for a period not exceeding [ten] 10 days.
c. Moneys received from fines under R.S.39:4-46 and this [article] section shall be accounted for and forwarded to the [director and by him paid over] chief administrator, who shall forward the fines to the State Treasurer, to be used as a fund for the repair of the improved roads throughout the State, regard being had to the repair of the most improved roads and the distribution of the benefits of [this article] R.S.39:4-46 and this section throughout the several counties of the State.

2. This act shall take effect immediately.
STATEMENT
This bill increases the fines for failing to display certain required information on commercial vehicles.
Current law requires the owner, lessee, or lessor of commercial vehicles, with the exception of passenger automobiles and vehicles owned leased by a pharmacy and utilized for delivery, to conspicuously display on the vehicle itself, or on a name plate affixed to the vehicle, the name of the owner, lessee, or lessor, and the municipality of the owner, lessee, or lessor's principal place of business. The sign or name plate is to be in plain view and be at least three inches high.
The current fine for a violation of this provision is $10. This bill increases the fine for these violations to $250 for a first offense, $500 for a second offense, and $1,000 for a third or subsequent offense.
