     Prohibits tobacco use in dormitory and other student residence buildings of institutions of higher education.

An Act concerning the use of tobacco products in student residence buildings of institutions of higher education and amending and supplementing P.L.2005, c.383.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 4 of P.L.2005, c.383 (C.26:3D-58) is amended to read as follows:

     4.    a.  Smoking is prohibited in an indoor public place or workplace, except as otherwise provided in this act.

     b.    Smoking is prohibited in any area of any building of, or on the grounds of, any public or nonpublic elementary or secondary school, regardless of whether the area is an indoor public place or is outdoors.

     c.     Smoking is prohibited in any dormitory or other student residence building which is located on the grounds of, or is owned, leased, or controlled by, a public or private institution of higher education.

     2.    (New section)  In addition to the prohibition on smoking provided in subsection c. of section 4 of P.L.2005, c.383 (C.26:3D-58), the use of chewing tobacco, or any other tobacco product the use of which does not require smoking as defined in section 3 of P.L.2005, c.383 (C.26:3D-57), is prohibited in any dormitory or other student residence building which is located on the grounds of, or is owned, leased, or controlled by, a public or private institution of higher education.

 

     3.    The Commissioner of Health, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), shall adopt rules and regulations as the commissioner determines necessary to effectuate the purposes of this act.

 

     4.    This act shall take effect immediately and shall apply to any housing agreement or lease entered into on or after the first day of the fourth month next following the effective date for a unit in a dormitory or student residence building which is located on the grounds of, or is owned, leased, or controlled by, a public or private

institution of higher education.

STATEMENT

 

     This bill amends the "New Jersey Smoke-Free Air Act," which prohibits smoking in indoor public places, to prohibit smoking and other tobacco use in any dormitory or other student residence building which is located on the grounds of, or is owned, leased, or controlled by, a public or private institution of public education. The bill expressly includes in this prohibition chewing tobacco and other tobacco products which do not require smoking.

     A violation of the Smoke-Free Air Act is punishable by a fine of not less than $250 for a first offense, a fine of not less than $500 for a second offense, and a fine of $1,000 for a third or subsequent offense.

     The bill would take effect immediately and apply to any housing agreement or lease entered into on or after the first day of the fourth month next following the effective date for a unit in a dormitory or student residence building which is located on the grounds of, or is owned, leased, or controlled by, a public or private institution of higher education.
