SYNOPSIS
Prohibits municipal ordinances from requiring license tag to use bicycles within municipality.

An Act concerning ordinances regulating the use of bicycles in a municipality and supplementing Title 40 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. The governing body of a municipality shall not adopt or enforce any ordinance or resolution, which within the municipality authorizes the issuance of a license tag, or requires possession of such a tag, for: (1) riding a bicycle; (2) operating a bicycle; (3) propelling a bicycle; (4) renting a bicycle; (5) owning a bicycle; or (6) buying and selling a bicycle.
b. Any ordinance adopted by the governing body of a municipality in violation of subsection a. of this section shall be null and void.
c. As used in this section, "bicycle" means a vehicle with two wheels propelled solely by human power and having pedals, handle bars and a saddle-like seat. The term shall include a bicycle for two or more persons having seats and corresponding sets of pedals arranged in tandem.
2. This act shall take effect immediately.
STATEMENT
This bill prohibits municipalities from adopting or enforcing ordinances or resolutions which would authorize the issuance of license tags for using a bicycle and thereby requiring license tags to use a bicycle within a municipality.
Specifically, this bill prohibits a municipality from adopting or enforcing any ordinance or resolution, which within the municipality authorizes the issuance of a license tag, or requires possession of such a tag, for: (1) riding a bicycle; (2) operating a bicycle; (3) propelling a bicycle; (4) renting a bicycle; (5) owning a bicycle; or (6) buying and selling a bicycle.
Additionally, municipal ordinances or resolutions adopted by the governing body of a municipality in violation of the bill would be considered null and void.
