Be It Enacted by the Senate and the General Assembly of the State of New Jersey:
1. In addition to the amounts appropriated under P.L.2020, c.97, the annual appropriations act for Fiscal Year 2020-2021, there is appropriated the following sum for the purpose specified:

2. This act shall take effect immediately.
STATEMENT
This bill makes a supplemental appropriation of $10,000,000 to increase payment rates to providers of day habilitation services for individuals with intellectual and developmental disabilities (I/DD) who are enrolled in the Division of Developmental Disabilities' (DDD) Supports Program and Community Care Program. In calendar year 2021, NJ FamilyCare reimbursement rates for day habilitation services increased between $0.32 and $1.68 per hour, depending upon client acuity, compared with calendar year 2020 rates. Hourly reimbursement amounts in calendar year 2021 range from $10.52 for the lowest acuity clients to $69.84 for those enrollees who need more intensive assistance. The State requires all service providers working with Supports Program and Community Care Program clients to be approved Medicaid service providers. Moreover, DDD requires individuals enrolling in either the Supports Program or the Community Care Program to secure and maintain eligibility for NJ FamilyCare benefits. By reimbursing all Supports Program and Community Care Program services providers, including providers of day habilitation services, on a fee-for-service basis, the State is eligible to draw down federal Medicaid matching funds in an amount equal to 50 percent of total NJ FamilyCare expenditures for such services.
The Supports and Community Care programs provide an individualized array of supportive services to qualifying NJ FamilyCare-eligible individuals with I/DD and their families. Enrollees whose individual services plans include day habilitation services engage in as many as 30 hours per week of activities designed to develop and support participants' self-help, social skills, adaptive skills, problem-solving skills, daily living skills, and leisure skills. Day Habilitation services are typically offered in a community-based or center-based setting.
