SYNOPSIS

     Prohibits person convicted of certain crimes from obtaining certain specialty license plates.

An Act prohibiting certain persons from obtaining certain specialty license plates and amending P.L.1959, c.56 and P.L.2000, c.15.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Section 3 of P.L.1959, c.56 (C.39:3-33.5) is amended to read as follows:

     3.    a. Except as provided for courtesy marks in section 2 of P.L.2000, c.15 (C.39:3-33.5a), no particular identifying mark or special [organization] license plate [issued pursuant to P.L.1987, c.374 (C.39:3-27.35)] may be issued to any applicant who:

     [(a)] (1)      for the 10-year period [next] immediately preceding the date of application for a particular identifying mark or special organization license plate has been convicted of a violation of [either section] R.S.39:4-50, [or section] R.S.39:4-96 [of this Title] , or section 2 of P.L.1966, c.142 (C.39:4-50.2), or has been convicted of a violation of a law of a substantially similar nature in another jurisdiction; [or]

     [(b)] (2)     has been convicted of a violation of N.J.S.2C:11-5, or has been convicted of a violation of a law of a substantially similar nature in another jurisdiction; [or]

     [(c)] (3)      for the two-year period [next] immediately preceding [his] an application for a particular identifying mark or a special organization license plate has had [his] driving privileges in this State or in another jurisdiction revoked or suspended for any reason whatsoever; or

     (4) has been convicted of a violation of paragraphs (1) and (2) of section a., section b., and paragraphs (3) and (4) of section c. of N.J.S.2C:14-2, or paragraph (1) of section a. and paragraphs (3), (4), and (5) of section b. of N.J.S.2C:24-4, or has been convicted of a violation of a law of a substantially similar nature in another jurisdiction, or has been has been convicted of or adjudicated delinquent for a sex offense enumerated in subsection b. of section 2 of P.L.1994, c.133 (C.2C:7-2) and the victim of the offense was under 18 years of age, regardless of the date of conviction.

     b.  A holder of a particular identifying mark or special license plate shall surrender any license plate containing a particular identifying mark or any special license plate to the New Jersey Motor Vehicle Commission if the holder of the license plate is convicted or adjudicated delinquent of a crime enumerated in subsection a. of this section or has had driving privileges revoked or suspended pursuant to subsection a. of this section.

     2.  Section 2 of P.L.2000, c.15 (C.39:3-33.5a) is amended to read as follows:

     2.  No courtesy mark may be issued to any applicant who:

     a.     has been convicted of a violation of [either section] R.S.39:4-50, [or section] R.S.39:4-96 [of this Title] , or section 2 of P.L.1966, c.142 (C.39:4-50.2), or has been convicted of a violation of a law of a substantially similar nature in another jurisdiction; [or]

     b.    has been convicted of a violation of N.J.S.2C:11-5, or has been convicted of a violation of a law of a substantially similar nature in another jurisdiction; [or]

     c.     for the two-year period [next] immediately preceding [his] an application for a courtesy mark has had [his] driving privileges in this State or in another jurisdiction revoked or suspended for any reason whatsoever; or

     d.    has been convicted of a violation of paragraphs (1) and (2) of section a., section b., and paragraphs (3) and (4) of section c. of N.J.S.2C:14-2, or paragraph (1) of section a. and paragraphs (3), (4), and (5) of section b. of N.J.S.2C:24-4, or has been convicted of a violation of a law of a substantially similar nature in another jurisdiction, or has been has been convicted of or adjudicated delinquent for a sex offense enumerated in subsection b. of section 2 of P.L.1994, c.133 (C.2C:7-2) and the victim of the offense was under 18 years of age, regardless of the date of conviction.

     A holder of a courtesy mark shall surrender any license plate containing a courtesy mark to the New Jersey Motor Vehicle Commission if the holder of the license plate is convicted or adjudicated delinquent of a crime enumerated in this section or has had driving privileges revoked or suspended pursuant to this section.

     3.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits a person convicted of sexual offense against a child from obtaining personalized license plates, special license plates, or courtesy license plates, which are license plates that contain three letters and a number 1 through 20.

     The bill requires the holder of personalized license plates, special license plates, or courtesy license plates to surrender the license plates to the New Jersey Motor Vehicle Commission if the holder of the license plates has been convicted or adjudicated delinquent of a crime enumerated in the bill or has had their driving privileges revoked or suspended in accordance with the bill.   

     Under current law, a person is prohibited from obtaining personalized license plates or certain organizational plates, if the person has: been convicted of convicted of driving while intoxicated, a refusal to provide a blood alcohol sample, or reckless driving in the 10-year period prior to an application for the special plates; ever been convicted of vehicular homicide; or had driving privileges revoked or suspended in the two-year period prior to an application for the special plates.  

     Current law also prohibits a person from obtaining courtesy license plates, if that person has: ever been convicted of convicted of driving while intoxicated, a refusal to provide a blood alcohol sample, or reckless driving; ever been convicted of vehicular homicide; or had driving privileges revoked or suspended in the two-year period prior to an application for the special plates.
